Jesse Furr - Wrongfully Sentenced

The Issue

I am writing on behalf of my brother in law Jesse Robert Furr. Jesse has been incarcerated since 1991 for the shooting death of his step mother. Before you stop reading there and assume guilt please hear us out. Jesse did in fact shoot his step mother BUT it was a complete accident. His father Jesse SR was out on a hunting trip with friends and Jesse Jr was home with his step mother. Jesse Jr, 21 at the time, was drinking and messing around with a gun. Eventually it accidentally went off shooting and killing his step mother Ruth. Jesse, drunk and terrified of what just happened left Arkansas and drove to Midland, TX where his mother lived. He was arrested upon arriving in Midland. During the jury selection the Judge asked Juror #6 "if you were sitting where Jesse is sitting would you want a person just like you just like your frame of mind to be on this jury" This Juror answered "NO SIR". Defense asked to have this juror removed. The Judge asked Juror #6 "If selected to sit on this jury, can you be fair and impartial?" Juror answered "I will try sir" The Judge Said "Well. I suspect that's all that any of us can ask is that you try." Juror #6 was selected to sit on the jury!  Judge asked all potential jurors "does anybody for any reason  other than what we have discussed up until now, have a problem serving this jury if selected? Potential Juror Mr. Scott stated "The time table caused him problems as he needed to be in Atlanta Georgia by 11:00 am Friday." to which the Judge replied "well Mr Scott, I can assure you one thing I am going to be in front of a television set come 11:00 am Friday Morning." Counsel was also ineffective and trial Judge further demonstrated his unfair bias when potential juror McCristian informed the court that he was a friend of the victims family. McCristrian was selected as juror #8. This was extremely prejudicial to Jesse's trial. His fate was set before the trial begun. The firearms "expert" Dr. Malak testified Ruth was shot at point blank range due to the amount of gun shot residue.Later he testified he had to use a microscope to see and collect the gun shot residue. Why did he need a microscope if there was so much gun shot residue.Dr. Malak also preformed the autopsy. He stated the victim was 76 inches putting Ruth at 6 feet 4 inches. Later he recounted stating she was 67 inches putting her at 5 feet 7 inches. Dr. Malak was inconsistent through out the trial. Dr. Malak was forced to resign as Chief Medical Examiner for the state due to wrongdoing in his duties on numerous autopsies and reports but it was to late the damage was done in Jesse's trial. They sentenced him to LIFE.  It was an honest accident and he made an error in judgement by leaving like he did but he did not deserve life in prison for an accident. He has currently been in prison in Arkansas for the past 29 years. He has appealed his case back in the 90's all the way through the courts and has been denied. We are looking to get this petition signed and get him clemency as his trial was full of biased people and mistakes. While in prison Jesse has completed numerous courses and has many degrees and I can show those to anyone who is interested. Jesse certainly has not wasted his life behind bars. He does however deserve a chance at life outside of prison bars. A chance to hug his mother, sleep on a real bed, eat healthy food, have a job, go to a park. Everyday things we all take for granted.
