The Issue

 Mayor Mobolade,

As you may be aware, a Data Center is in the preliminary stages of establishing its ugly presence at the old Intel Fabrication Bldg on Garden of the Gods Rd. I say ugly because that’s exactly what it is, by design, and will become more so as time goes by.

Previously, at this same site, a BitCoin Mining operation reared its ugly head for 4 long years, violating all noise codes that were on the books, without facing any  repercussions or penalties whatsoever.  The neighborhood of Chelsea Glen - specifically on Chutney Ct - was devastated, not only by the outrageousness of the noise, but more so by the neglect inflicted by the City’s Neighborhood Services and the Planning and Development Department.

The City’s Noise Code speaks for itself. It clearly defines the allowable limits for daytime and nighttime noise levels. It’s been in the City Charter since 1971. Can it be so difficult to understand?

Despite this clarity, it was ultimately decided by the powers that be in Mayor  Suthers’ administration to allow this travesty to continue. The City Attorney made the decision that pursuing prosecution was not feasible.  When would it be be feasible?  Although blatant violations were well documented by Code Enforcement Officers - as well as Citizen watchdogs - they were completely ignored.

As you may know, the BitCoin Mining operation was run by a company named 3G Venture II.
From June of 2018 through November of 2022 this company lied and misled the residents who were immediately affected.  In some Bizarro World where justice is regularly ignored, COS became the model that 3G Venture II loved - where violations could occur regularly and “enforcement” of these existing violations were conveniently set aside for future prosecution.

Pursuit of justice never happened. The residents lost out.  Trust, respect, and confidence in the City’s Neighborhood Services collapsed.

Now, we are revisiting the same thing all over again - Deja Vu !! but with a different face, that of an AI Data Center.  That face is the current developer, Raeden Corporation. They will buy up 3G Venture’s property and inflict a similar insult but with a different narrative:  “The company plans to install attenuated walls and screens to prevent noise from reaching the community. The neighbors should not hear a thing.” So says Jason Green, the COO of Raeden Corp, the Developer, in an article published by KRDO on their website on April 6, 2026 by Mackenzie Stafford.  This is preposterous!  If it’s possible to mitigate the sound to this degree, where “the neighbors should not hear a thing,” we would have already heard of existing Data Centers somewhere in the country where neighbors could “not hear a thing.”  It’s hard to trust anything Mr Green says after hearing such a claim.

I suggest that, before this process is allowed to continue, the City, at your lead, sir, calls for a pause, a moratorium, of this current plan and all other proposed Data  Centers until it can be fully studied.

Thanks for your time and consideration.
