The Issue
Illinois Notaries provide a very essential service to Illinois residents. We play a vital role in preventing fraud and forgery by administering oaths, properly identifying signers, and validating signatures. Our services are important to businesses and individuals alike.
The traditional ways of handling business matters have significantly changed with time. With these changes come more flexible options and ways to complete business transactions, real estate closing, and personal paperwork. The need for mobile notarization has risen and given birth to providing great convenience to the public at large. Mobile Notaries also assist with providing essential services to seniors and those who are shut-in. While in traditional days one would seek a physical location to travel to and find a notary within establishment business hours. Now with a simple call, a notary can be available at most hours of the day. We travel to homes and businesses daily. Our travel saves our clients time and allows them to be more efficient in their day-to-day activities.
It is unfortunate that our maximum fee allowed per notarization does not even begin to reflect that level of service we provide, the importance of proper notarization, nor does it account for the level of responsibility and liability we undertake when notarizing documents. Currently, IL's maximum fee per notarization is $1. A consumer will pay more for a bag of chips than they would to secure a Notary Public who has the charge of helping in fraud prevention and administering oaths.
We are calling on Governor Pritzer, The Secretary of State, Jesse White, and the Illinois General Assembly to make changes to the General Provision (5 ILCS 312/) Illinois Notary Public Act. In specific Sec. 3-104 Maximum Fee. We are requesting that the maximum allowable fee of $1 per notarization be increased to at least $10 per notarization. Our fees should be a reflection of the professionalism, convenience, responsibility, and liability that comes with performing our notarial duties.
