Am 01. Februar hat ein Militärputsch in Myanmar stattgefunden. Die gewählten Politiker wurden festgenommen. In der Wahl im November 2020 hat die Partei NLD eine klare Mehrheit der Stimmen gewonnen, die militärische Partie wenig. Die NLD wurde demokratisch als die nächste Regierung gewählt. Die Führer des Militärs haben das Ergebnis nicht akzeptiert. Seit 01.Februar haben Tausende von Leute friedlich auf der Straße protestiert. Das Militär schießen die Protestierten und nehmen viele fest. Mehr als 700 Zivilisten sind schon getötet und mehr als 4,000 festgenommen. Das ist kein Krieg sondern ein Massaker. Die Menschen sind unbewaffnet. Diese Partition geht um die Benennung des Militärs als Terrorist Organisation. Dabei ist ein Schreiben an die Council of the European Union. Request to Add Myanmar State Administration Council to the EU Terrorist List
We are writing to you to request the Council of the European Union to add the Myanmar State Administration Council (‘SAC’). This is as the SAC is a terrorist organisation under the European Union’s Council Direct 2017/541 of 15 Mar 2017 (‘the Directive’).
THE DIRECTIVE
“Terrorist group” is defined as a structure group acting in concert to commit terrorist offences.[1]
“Terrorist offences” under Article 3 of the Directive provides intentional acts which may seriously damage a country with the aim of either:
● seriously intimidating a population;
● unduly compelling a government to perform or abstain from performing any act; or
● seriously destabilizing or destroying the fundamental political, constitutional, economic or social structures of a country.
ACTS OF TERRORISM
Myanmar’s security forces are notorious, even before the coup, with the Rohingya persecution which involved killings, arson, enforced disappearances, extortion, severe restrictions on movement, and lack of food and healthcare.[2]
On 1 Feb 2021, the same security forces unconstitutionally instigated the coup and called themselves the State Administration Council. Since then, the SAC has committed numerous crimes against humanity such as torture, arbitrary detentions, and murder on a nationwide scale.[3]
Their intentional actions have included:
● attacks upon civilian’s lives[4] by intentionally shooting live rounds with machine guns[5] and air strikes[6], injuring unarmed civilians including children[7] and the disabled[8], and resulting in over 600 civilian deaths[9];
● kidnapping or hostage taking of over 2,700 political prisoners both day and night[10];
● use of explosives or weapons such as dropping bombs onto villages[11];
● causing fires, the effect of which is to endanger human life[12];
● threatening to commit the acts above, e.g. through national TV saying that the military would shoot at protesters heads[13]; and
● creating a serious risk to the health or safety of the public or section of the public, such as confiscating IMF’s $350 million in emergency aid to Myanmar[14] and the donated vaccines[15] for their own use;
Since the coup, the SAC has committed innumerable human rights violations, ranging from the breach of freedom of expression and freedom of assembly to freedom from arbitrary detention and freedom from torture[16].
The use and threat of these violence actions have been to seriously intimidate the civilian population for the purpose of advancing the SAC’s political cause to remain in power as the authoritarian government. They have done the same in 1988 when they responded to nationwide protests with physical violence and psychological welfare, and grabbed power by creating the State Law and Order Restoration Council to “restore peace”[17].
Thus, we strongly urge the European Union to add the Myanmar SAC to the EU’s Terrorist List as it meets the necessary criteria of a terrorist organisation under the Directive.
WHY WE NEED YOUR HELP
We are requesting the EU’s help to add the SAC in the EU Terrorist List with the primary objective of stopping the SAC from gaining access to their financial assets.
Declaring the SAC as terrorists will render provision or collection of funds, directly or indirectly, with the intention that they be used, or in the knowledge that they are to be used, in full or in part, to commit, or to contribute to the commission of the terrorism offices under the Directive punishable as a criminal offence in the EU’s Member States[18]. Under Article 20 of the Directive, Member States’ authorities will have a duty to freeze or confiscate the proceeds derived from the SAC’s terrorist offences. Thus, this would prevent the SAC from accessing any of their foreign financial reserves in the European Union. Without fewer financial resources, the SAC will gradually lose its ability to continue funding its violent crimes against civilians.
Therefore, for the prevention of further loss of civilian lives, we are requesting the Council of the European Union to add the Myanmar SAC to the EU Terrorist List.
