A revision to the 13th amendment to remove the loophole

A revision to the 13th amendment to remove the loophole

The Issue

The 13th amendment states: "Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction." although slavery was declared to be abolished , the 13th amendment allowed for a loophole in the discontinuance of slavery or involuntary servitude by allowing it to be legal within our prison system for the purpose of punishment. However, this loophole has allowed for many states, if not all, to take advantage of this rule by allowing for longer prison sentences , unfair sentencing, and unequal practices within our system that not only allows for individuals of color to work for no pay, but to be forced to do so against their will or suffer consequences. The loop hole of involuntary servitude in our very obvious racist system that is being discussed and addressed by our current administration shows a clear picture of how black men are sentenced to longer prison time than white men for the same crime, are more likely to be re-entered into the prison system for lack of rehabilitation , inability to meet the demands placed on them by the state releasing them and thereby being returned to prison for non-compliance of near impossible requirements put on them. The benefit here is that our states have taken advantage of the 13th amendment loophole  to allow for involuntary servitude which if we are honest, in our very racist system, is still a form of slavery, and enforce free labor upon prisoners that are not afforded the choice to refuse. While working in the prison as an inmate sells the idea that they are gifted gain time which can result in early release ,Many, if not all, are still placed on probation or parole for a length of time that for many equals the full amount of sentencing time originally placed on them. So inmates are forced to work for no pay, and if refused, can be disciplined including solitary confinement for 30 days or longer and then promised early release based on gain time to then be placed with impossible  demands such as paying fines, paying for psychiatric or addiction services and assessments, and still under the control of the state which limits their freedoms after being released from prison that sentenced them to limited freedom. The 13th amendment clearly is still allowing for a form of slavery through its less aggressive way of defining it as involuntary servitude. Our country has been controlled by racism through the use of power to enforce inequality for people of color through use of our laws and constitution to support these very unfair acts that continue to breed racial disparity in our country. This amendment, while stating freedom ,in the same breath also continues bondage. We, as the people of the united states, The united states that fought and continues to fight for freedom and equality for every man and woman regardless of race, religion, or gender, are demanding that this amendment be addressed and revised to rid the legality of involuntary servitude as it was created during a time that was meant to be specifically targeted to black men and women and today in 2021 is still working as such We request that you, as representatives of the people, hear us and take action!!
