Justice for Arayla: Autistic Rape Victim
The Issue
Arayla is a five year old, minimally verbal child on the autism spectrum. She is my cousin. After learning the horrors she and her mother endured, I wanted to help. I need your help also for Arayla to be returned to her mother and sister, bring her rapist to justice, and support her legal fund to enact new legislation. This will ensure that this can never happen again to another child in America. Below is the description of events from her mother, that have taken place.
For the past four years, her doctors, therapists and myself have all made reports to the department of child services regarding signs of sexual abuse. Since she is minimally verbal, the agency declined to interview her and consequently unsubstantiated the reports. The police department even declined to investigate. Enraged, I contacted state officials imploring them to amend their policies on how they handle cases involving children with no autonomy and those with special needs. In September of 2012, my daughter was diagnosed with chlamydia. After I sought treatment for her, she and my younger daughter were removed from my care, since I caused so much negative attention on the agency's blatant discrimination regarding my daughter and her disability. While out of my care, she tested positive for a second time for chlamydia, eight weeks after treatment and well enough time so it would not be considered the same infection. The department of child services refuses to return her to me even though I have been cleared of all safety risks. They have her placed with the family I think is responsible for hurting her. They have manipulated and corrupted my case, instead of getting my daughter justice. This is why I am fighting. I'm fighting to get her back, I'm fighting to bring her abuser to trial, I'm fighting for justice for Arayla! We need your help to bring her home! Timeline of Events End of June 2008 Received Arayla back from visitation with father. She had tearing on her anus which was discovered while I was changing her diaper. I took her to **** hospital and they informed me that since she had been gone from my care longer than 24 hours there would be no physical evidence to collect. DCS was notified and they notified her father and he then took her to **** Hospital to be examined at 1am in the morning on 7/09/2008. Report was unsubstaintiated October 8, 2010 Received Arayla back from visitation. She screamed and cried everytime she was asked if she had to potty and frequently wet herself. Took her to be checked out by her pediatrician. She had no signs of trauma and was tested for a UTI. Test was negative. Ped's opinion was that she suffered some type of trauma in the bathroom for her to be acting this way. I then took her see Dr.*** at the ****. Dr.*** had been monitioring Arayla's developmental progress since her Austism Spectrum Disorder diagnosis in 2009. Dr. *** also felt that Arayla suffered some type of trauma, even though there was no physical evidence. Reported to DCS and unsubstaintiated. NOvember 2011 Arayla and Ava (my other daughter that does not share the same father as Arayla) spent the night with Arayla's grandparents in the end of October 2011 (around Halloween). Arayla started walking up to strange men and climbing on them and trying to put her hand down their pants to reach for their genitalia. Ava inserted a princess wand into her vagina. I took them both to see pediatrician. Dr. *** said that Ava's behavior was consistent with a two year old's behavior, but Arayla's behavior was suspicious for sexual abuse. Dr. *** found no signs of trauma and did not contact DCS because we came up with a safety plan that was implemented. The safety plan was that we switch daycare and that Arayla not be alone with any adult males because her behavior was specifically targeting adult males. Dad was opposed to making any changes and did not on his end. February 17, 2012 DCS report filed by pediatriciatian's office. Case worker *** *** said more than once that this report would be substaintiated because of the history and evidence. At the end of the report, the call was made by someone higher than ***'s supervisor to unsubstaintiate the case due to their "no perp, no case" agency policy. This reference was made because Arayla's disability causes her limited verbal ability. Sgt.*** of IMPD refused to pick up the case and the forensic interviewer refused to interview Arayla. March 27, 2012 Contacted *** at the Indiana Protection and Adovcay Services center about filing a complaint against DCS for the discrimination Arayla recieved. Timeline of Events continued... April 2012 Received a letter from IPAS stating that Arayla's ADA rights had not been violated and that there would be no further involvement from this office at this time. April 27, 2012 New DCS case opened from report from the *** Center for Autism. Conducted by ***. Safety plan signed to keep Arayla away from grandparents until the end of the investigation. Unsubstaintiated. End of June/Beginning of July 2012 New DCS case opened and assigned to ***. *** reiterated the "no perp, no case" policy at our first meeting and after the second meeting, I subsequently did not hear from her. July 10, 2012 I contacted Gov. Daniels, Lt. Gov. Skillman, Rep. Bardon and Senator Taylor via email about amending the statue that defines what a perponderance of evidence is as it pertains to children with special needs and those with no autonomy. August 3, 2012 Received email coorespondence from Director James Payne of DCS saying that I should contact my state representative if I needed help with legislation. August 7, 2012 I emailed Director Payne back and informed him of the current open case that we have and implored him for help before this case was closed out like the others. August 9, 2012 Received voicemail from ***, Division Manager at DCS. August 22, 2012 Spoke with *** again and he informed me that he was having a meeting that day with my csae manager and her supervisor. August 23, 2012 *** did a home visit and tried to contact *** (Arayla's grandfather) September 6, 2012 Arayla was taken to ER due to behavior her school contacted me about. I contacted *** who said she was still trying to get in touch with the ***. September 10, 2012 *** contacted me about another home visit and a team meeting on Sept 12 so we could brainstorm on how to keep Arayla safe. September 11, 2012 Home visit. Arayla diagnosed with chlamydia. September 12, 2012 Dr. ***, head of ***'s Children's Services Team strongly recommended that Arayla not be allowed around any male caregivers and her profile of the perpetrator was an adult male that was close to her and saw her on a consistent basis and had frequent access to her. Case supervisor, ***, said that she "did not have enough evidence to make Arayla a CHINS case and since Dr. *** is not a member of the DCS staff, what she says does not determine what they do." Arayla was allowed to keep her visitation with dad. September 12-14, 2012 I called every supervisor and director that I had a number for and left messages and still have not received any contact back. September 20, 2012 Both of the children were taken into custody by DCS and CHINS proceedings were initiated. The girls went to their fathers and I received supervised visits at an agency. October 22, 2012 At one of my supervised visits, I noticed discharge in Arayla's panties. She was taken to the doctor and tested positive for a second time after treatment for chlamydia. This was a live culture. November 26, 2012 The judge ordered placement of Ava back home with me and the judge authorized placement of Arayla with me as long as I got a positive recommendation from my team. On that day, it was also discovered that my case manager had been sending referrals out to service providers that were supposed to be advocating for me. In the referrals she included information intended to assassinate my character with her own personal bias. We asked for a new case manager due to the irreparable damage she caused and we were denied. January 8, 2013 Granted unsupervised visits and my case manager had someone show up at every visit to sit with me for an hour. One week prior to this, it was documented that Arayla had discharge in her panties again and bruises on her inner thigh. I attempted to take her to the doctor to get checked, but family case manager called and told the doctors to refuse to see us. January 24, 2013 Case is closed with Dad now having Arayla placed with him despite there being no safety concerns with me. We are now being sent to family court where I have to fight to get her back again. I don't have the resources to help fight to bring her home. This is why I came to the public for your help. No child should ever have to go through what my daughter has and will continue to go through if she doesn't come home now.
