Update MI Surrogacy Laws

The Issue

Parents going through surrogacy have so much to worry about and the parental rights to their child should not be one of them. Please change the MI Surrogate Parenting Act, Act 199 to 1988 so that a parentage contract is admissible in court. 

As it stands, a surrogate parentage contract is void and unenforceable. We want this changed. The Surrogacy Agreement written up by a Lawyer, signed by the intended parents, as well as the surrogate, should be enforceable in court. The Judge should not have the authority to over rule the wishes of both parties, especially since there is a contract in place. 

If my husband and I are denied a pre-birth order (an agreement signed by the surrogate and the intended parent(s) before the child is born, declaring the intended parent(s) as the legal parent(s) of the child), we will need to go through the adoption process to adopt our own baby back. This means going through a court proceeding and submitting ourselves to home visits from a social worker, personal questions about our upbringing and our approach to parenting, and criminal background checks. We must get reference letters testifying to our character and will need “temporary permission” from the surrogate and her husband to see our own child.
