The Issue
I was a victim of a corrupt dentist who used the Indiana Medical Malpractice Act as a shield. This dentist, motivated by greed, performed unnecessary and expensive procedures that caused me significant harm. I know I am not alone in this ordeal, as many others in Indiana have suffered due to the loopholes in this Act.
The Indiana Medical Malpractice Act currently includes dentists under its protections, which allows those with ill intentions to hide behind it. This Act is meant to protect healthcare providers who adhere to ethical and professional standards in their practice, but unfortunately, some exploit its provisions for personal gain at the expense of patients. This needs to change.
Dentists, while integral to oral health, differ significantly from other healthcare providers in terms of the nature and risks of their services. By excluding dentists from the Act, we can ensure that those who practice unethical and harmful dentistry are held accountable for their actions.
Studies show that dental malpractice is prevalent, with many patients experiencing substandard care, unnecessary treatments, or outright fraudulent practices. The lack of oversight and accountability harms not only the patients but also tarnishes the reputation of ethical dental practitioners.
Our goal is to amend the Indiana Medical Malpractice Act to exclude dentists, thereby closing this loophole that permits irresponsible dentists to exploit patients. This initiative is not just about justice for the wronged, but about protecting future patients and upholding the integrity of dental practice in Indiana.
This change will compel dentists to operate with higher standards of accountability and honesty. It will also propel the state to introduce a separate, more stringent body to oversee dental practices and address grievances, ensuring that patient complaints are handled with the seriousness they deserve.
To achieve this change, we must urge Indiana legislators and relevant authorities to consider the unique context of dental services and the implications of including them in the Medical Malpractice Act. The Medical Malpractice Act stands as a barrier , to deter and discourage victims of corrupt dentists from their constitutional right to be heard in the court of law, I am forced to go through a medical review panel in order to proceed to filing my case in the Indiana Superior court and the WINNER , yes you heard that right the WINNER of the findings of the review panel must pay 4.000 dollars to the panel members further causing financial harm to the victim if he or she decides to pursue Justice being served.
This act is unconstitutional and violates citizens right to Court.
