Protect Wyoming employees from workplace bullying and harassment
The Issue
Did you know that employees in the workplace are only protected from workplace bullying, abuse and hostility IF it falls under the Wyoming Fair Employment Practices Act? The Wyoming Fair Employment Practices Act protects those that experience discrimination in relation to age, sex, creed, color, disability, national origin, ancestry or pregnancy in the workplace.
But what about everyone else?
Workplace bullying is when a hostile work environment is created outside of the protected classes. Nation wide, 37% of adult Americans report experiencing workplace bullying. 44% report that they have worked for a supervisor they consider abusive. Unfortunately, 80% of workplace bullying is completely legal!
Wyoming is a rural, At-Will State where the mentality is to "cowboy up", but wouldn't we be better off if we treated everyone with respect, courtesy and the right to a healthy work environment? Don't we want our loved ones coming home feeling happy, accomplished and safe?

What the HWB Does for Employers
-Precisely defines an "abusive work environment" -- it is a high standard for misconduct
-Requires proof of health harm by licensed health or mental health professionals
-Protects conscientious employers from vicarious liability risk when internal correction and prevention mechanisms are in effect
-Gives employers the reason to terminate or sanction offenders
-Requires plaintiffs to use private attorneys
-Plugs the gaps in current state and federal civil rights protections
What the HWB Does for Workers
-Provides an avenue for legal redress for health harming cruelty at work
-Allows you to sue the bully as an individual
-Holds the employer accountable
-Seeks restoration of lost wages and benefits
-Compels employers to prevent and correct future instances
What the HWB Does Not Do
-Involve state agencies to enforce any provisions of the law
-Incur costs for adopting states
-Require plaintiffs to be members of protected status groups (it is "status-blind")
-Use the term "workplace bullying"
