Urge NJ Bar to Review Kai the Hitchhiker’s Trial

The Issue

Caleb “Kai” McGillvary, known as “Kai the Hatchet-Wielding Hitchhiker,” gained viral fame in 2013 after intervening in an assault in California. Kai, became an internet sensation with his unforgettable line, “Smash, smash, SUH-MASH!”

However, his life took a tragic turn when he was arrested for the murder of 73-year-old attorney Joseph Galfy in New Jersey.

In May 2013, McGillvary met Galfy in New York City and stayed at his home in Clark, New Jersey. Galfy was later found dead from blunt force trauma. McGillvary claimed he was drugged and sexually assaulted by Galfy, leading to the fatal confrontation.

Despite these findings, controversy surrounded the investigation and trial. Joseph Galfy was discovered face down, wearing only socks and underwear, and investigators allegedly found the date-rape drug GHB in his refrigerator. However, no rape kit was administered on Kai himself; instead, forensic testing focused on the alleged victim. Furthermore, a key factor in the prosecution’s case was testimony from Galfy’s friends and acquaintances, who asserted that he “wouldn’t do that,” a claim that strongly influenced the jury’s perception despite Kai’s self-defense argument.

McGillvary was convicted of first-degree murder in 2019 and sentenced to 57 years in prison. He appealed the conviction, alleging misconduct and ineffective defense counsel, but the conviction was upheld in 2021.

There are significant concerns regarding the handling of McGillvary’s defense and the trial’s fairness. Allegations of judicial misconduct and ineffective counsel have been raised, suggesting that McGillvary may not have received a fair trial.

We urge the New Jersey State Senate and the New Jersey State Bar Association to conduct a thorough review of McGillvary’s case to ensure that justice was served and that any potential miscarriages of justice are addressed.

This petition seeks to bring attention to potential injustices in McGillvary’s trial and to advocate for a fair and impartial review of his case. There have been numerous allegations of judicial misconduct and prejudices that may have skewed the due process owed to Kai.

Scrutiny has been cast about the fair representation Kai received and whether all evidence was appropriately considered and presented in court. In light of the potential miscarriages of justice, it is our duty to ensure that every individual, regardless of their background or notoriety, is afforded a fair and unbiased trial. Conducting an impartial review could lead to revelations essential for both Kai’s right to a defense and the principles of fair justice that our legal system upholds.

If errors were made, they must be addressed to preserve the integrity of our judicial processes. We call on the appropriate authorities to take action to uphold the principles of justice and fairness.
