Under 2 Year Employment Rights
The Issue
While in most cases of employment under 2 years, the employer does not necessarily need to justify their decision to dismiss, or even follow a fair procedure.
Part 10 of the Employment Rights Act 1996 provides employees with the right not to be unfairly dismissed however in most cases the employee must have two years' continuous service with their employer to qualify to bring a claim.
This means that anyone employed under two year do not have any rights to appeal, unless it is deemed to be against a protected characteristic.
The law should be changed so that employers do not have the power to dismiss workers without the need to justify. They should follow a fair process with anyone who is employed by them.
I have personally been subject to this kind of dismissal, and have had to suffer knowing there isn’t anything I can do about it, even though the dismissal was unfair.
I was given no prior warning that this was coming, nor was I given an invite to attend a meeting. Sounds unfair right? But this is perfectly acceptable in the eyes of employment law.
You may not know it yet, but this could affect you, or someone close to you and leave them without work.
