The Issue

My name is Anthony Schenck. My brother, Phillip Schenck, was sentenced to an  excessive amount of years for his crime. He was sentenced in a court room ran by the Federal Judge John McBryde. In the federal system you are required to give cooperation to the prosecution in order to receive "acceptance of responsibility". My brother was being forced to plea to testimony presented by the prosecution that he had no knowledge or engagement in. He would not agree to the testimony presented because he knew he would be lying to the court and to himself. Because of this, he was not given "acceptance of responsibility". It was later confirmed by the prosecution that they knew it was a mix up based on names and they did nothing to correct it. The prosecution knew that the testimony presented against Phillip did not pertain to his case whatsoever.  I have proof of this in my hands. When "acceptance of responsibility" is not given, sentences can easily double in time frame. I'm not saying my brother is innocent, but he does not deserve to spend the majority of the rest of his life incarcerated over it. This is blatant injustice. Phillip had a drug problem, and locking someone up for the rest of their life, I believe, is not the answer. He has had no disciplinary infractions his entire incarceration to date. He works daily to better himself even knowing he wont see the other side of the fence until 2050. I myself am a success story. I have done time and turned my life around. My brother is a success story, i just want him to be a success story with his family, in the outside world, not inside the fence. Please take the time to look into this, you will see the blatant disregard for Justice. I know with further investigation into this matter a change can be made.
