"Murder by Incarceration , Systemic Racism"
The Issue
For all of David Dew's life all he wanted to do was sing. Thirty eight years ago he found himself in San Diego, California at the wrong place and the wrong time. He met two gentlemen who asked him for a ride to pick up their things. With David waiting in his van listening to his music, the two gentlemen gathered their things and put them in David's van, and they drove away. It wasn't until two days later, David learned one of those men killed the gentleman.
When detectives arrived to question David, they never let him go. A public defender assigned to David was supposed to defend him, instead he set him up by orchestrating false testimony, "heresay" and documents. Three letters were also written in the presence of legal counsel by the person who did the crime, but were never presented to the judge and court which would have exonerated David and kept him from prison. Instead, the PD with a complicit Judge signed David's life away for 15 to life, "you'll probably get out in 7 years if you take the plea, or you might get the death penalty." David a black man, 23 years old, with a fifth-grade education and scared to death, changed his plea 8 times, he even fired the PD right before court but David was at their mercy and they all orchestrated to take his life away with a charge of 2nd degree murder but, their intent "Murder by Incarceration." The only charge David should had been arrested for was accepting stolen property.
Fast forward to 36 years later, Senator Nancy Skinner passed the SB1437 "The Felony Murder Rule" David was not the person who did the crime, so a petition was filed and a year and a half later, an angel appeared. An attorney of 33 years uncovered the ugly truth of San Diego, in David's case. As he appeared in court for his evidentiary hearing, our attorney knew that by the brief filed to the court, she was sure that David would finally be released. But now at 68 years old and 38 years later, another DA and Judge used the same "heresay and inadmissible documents that are against the law" and denied David's petition. An appeal has been filed, but this 'Ugly Unjust Cover Up" has now been exposed.
We are calling for an investigation to be done on David's case and San Diego's Judicial System. This is an unjust situation of systemic racism, judicial slavery and "Murder by Incarceration." Freedom for Truth, help us free David Dew !
During these times where the world is uncovering racially unjust scenarios, the prison systems have lined their pockets with state money, provided to them by incarcerating people who have done no crime.
