The Issue

This petition is for the Texas Legislature to end HOA foreclosures statewide.

Imagine losing your home—not because you missed a mortgage payment, but because your HOA decided to take it.

This is happening to Texas homeowners right now. Families, elderly neighbors, veterans, and struggling parents are being forced out of their homes over HOA fees as low as a few hundred dollars. In some cases, they don’t even realize what's happening until it’s too late. No judge. No oversight. No mercy.

HOAs have the power to foreclose on your home faster than a bank—sometimes in as little as 30 days. Yet banks, which are owed hundreds of thousands of dollars, must wait at least 180 days before they can even start the foreclosure process. How is this fair? It’s not. It’s home theft—legally sanctioned robbery.

We are calling on the Texas Legislature to put an end to HOA foreclosure abuse. It’s time to replace HOA foreclosures with liens, just like property taxes and mortgages. No Texan should lose their home over HOA dues. It’s time to fix this broken system.

What We Demand:
End HOA foreclosures. HOAs should never have the power to take your home—only the ability to place a lien and collect when the property is sold.
Extend structured repayment plans. Homeowners must have at least 36 months to repay overdue HOA fees, especially after financial hardship.
Establish a minimum default period. HOAs should not be able to foreclose faster than banks. Homeowners deserve at least 180 days to catch up before any legal action can begin.
Strengthen notice requirements. No more sneaky foreclosures. Homeowners should receive multiple written notices over 180 days, certified mail notifications, and clear repayment options.
Homeowner Dispute Rights. No homeowner should lose their home without the right to challenge fees before a neutral third-party mediator.
Prohibit surprise fee acceleration. HOAs must not be allowed to demand years’ worth of dues all at once without offering structured repayment plans first.

Why This Matters:
-> HOA foreclosures destroy families. Texas families are losing their homes, their financial security, and their futures over a system that is rigged against them.
-> HOA foreclosures erase a lifetime of hard work. Families who spent decades building equity are left with nothing when their homes are auctioned off for pennies on the dollar.
-> No accountability. There is no official record of how many Texas homeowners have lost their homes this way. This abuse continues because no one is tracking it.
