Support Top Wok Takeaway for fair council enforcement
The Issue
Top Wok Takeaway is a beloved, family-run business that has consistently provided excellent service and contributed positively to the fabric of our neighbourhood in Osbaldwick and Derwenthorpe. Unfortunately, this cherished establishment is now facing disproportionate council enforcement that threatens its survival.
Specifically, the owners are facing a demand for £50,000 worth of remedial work to be completed within an unfeasible 4.5-day timeframe following noise complaints from a single individual. The owners have proactively cooperated with the council and commissioned independent sound tests. However, the complainant has not attempted to engage directly with the owners to resolve the matter amicably, and the Council's harsh measures lack proportionality and fail to consider the unique circumstances of this family enterprise.
We believe that with proportionate and fair council enforcement, Top Wok can continue to thrive. We respectfully request that the council:
- Extend the Timeframe: Immediately pause the 4.5-day deadline to allow the owners a reasonable period to obtain accurate quotes and arrange the necessary works.
- Review Proportionality: Re-evaluate the £50,000 demand to ensure it is a realistic requirement for a local business.
- Verify Complaints: Objectively verify the claims of "several serious complaints" to distinguish between genuine community concerns and isolated grievances.
- Facilitate Mediation: Encourage a mediated dialogue between the business owners and the complainant to find a practical resolution.
Your support is crucial. By signing this petition, you will help urge local authorities to develop a more equitable approach to enforcement that supports, rather than hinders, the businesses vital to our community. Let’s stand together for fairness and ensure Top Wok Takeaway remains an integral part of our lives.
