Strengthen Legal Rights for Domestic Pets and Limit Unnecessary Euthanasia
The Issue
I am a resident of West Virginia, USA, and I recently experienced a devastating incident that has prompted me to start this petition. Three of my dogs were wrongfully accused and killed by the humane officer on the grounds of wounding cattle. There was no substantial proof provided, yet my dogs were deemed guilty and ordered to be killed. They were seized and killed the exact same day without giving me time to appeal the court’s decision, which is part of my due process.
The cattle in question not only survived the attack but required minimal care. Regardless of the dog(s) responsible, this was the first attack on the cattle by a dog and no resolutions were allowed or considered in this matter. I know livestock is a way of life and financial support for farmers and I understand the frustration and need to prevent further damages. But my dogs were more than just dogs, they were my family, companions and protectors. Not just my dogs, but anyones dog(s), deserve a second chance.
This is not an isolated incident; many pet owners have experienced similar situations due to inadequate laws protecting domestic pets' rights. It's time we change this narrative by strengthening legal rights for companion animals/domestic pets in West Virginia.
West Virginia is ranked #20 in overall animal protection, that is only medium tier. Currently West Virginia is the only state without laws prohibiting sexual assault of animals, this is not only concerning but deeply disturbing. They are given minimal, if any, protection or justice both as a victim and as the perpetrator.
According to data from the American Veterinary Medical Association (AVMA), approximately 1.5 million shelter animals are killed each year in America alone - a figure that could be significantly reduced with better legal protection for our pets.
We need legislation that prevents unnecessary killing and impoundment until it is absolutely deemed necessary by qualified professionals based on sound evidence rather than unfounded accusations or assumptions. There needs to be a holding period added to the law so that pet owners can have enough time to appeal their case if needed or seek legal counsel, they should be held atleast 10 days. Also, since our pets are considered personal property by the government, they should not be allowed to seize them without a warrant. There are so many grey areas in the WV legislative laws when it comes to domestic animals/companion animals and their rights. They can be taken from us for assumptions and accusations made by anyone. Instead of killing innocent pets, they should be given evaluation period and by licensed professionals who can attest or confirm their ability to be rehabilitated.
Let's ensure our beloved companions receive fair treatment under law, just as any other living being would deserve.
