The Issue

Nevada Governor Joe Lombardo wants to put transgender student athletes to a public vote. He has admitted it is part of his re-election strategy. And he needs 150,000 signatures by June 24 to make it happen.

Lombardo's proposed ballot initiative would require all school sports in Nevada to categorize athletes by their assigned sex at birth — effectively banning transgender girls from competing on girls teams and transgender boys from competing on boys teams. The Nevada Supreme Court is currently weighing whether the initiative even meets legal requirements to appear on the November ballot.

Here is what Lombardo has not said publicly: it is unclear whether there are any transgender student athletes in Nevada at all. The organization overseeing high school sports in the state does not even track that number. This is not a policy solution to a documented problem. It is a political wedge designed to drive turnout for a governor facing re-election.

Transgender students are not a threat to school sports. They are kids who want to play. They already face enormous barriers, stigma, and pressure. A statewide ballot initiative that singles them out for exclusion does not protect fairness. It targets children for political gain.

Nevada's Equal Rights Amendment already restricts discrimination based on gender. This initiative carves out an explicit exception to that protection.
