Stop Disability Discrimination in the VA

The Issue

For over 17 years, I've proudly dedicated myself to serving our nation's veterans at the VA, processing over 50,000 benefit claims and receiving recognition for my contributions. Despite managing multiple disabilities, I've diligently fulfilled my duties, earning annual outstanding appraisals nearly every year and prestigious awards like the Frank Steck Spinal Cord Injury Coordinator Award for my commitment to supporting veterans with neurological disorders.

My disabilities unfortunately became overwhelming, prompting me to request a reasonable accommodation to work from home, allowing me to better manage my physical and debilitating symptoms. All of my essential job functions can be efficiently performed remotely. The VA Human Resource division conducted a thorough evaluation of my doctors' medical evidence and statements, ultimately recommending full-time telework as a suitable accommodation. Regrettably, my supervisor disregarded this recommendation, denying my legitimate need for accommodation and subsequently terminating my employment. This unjust decision not only deprives me of income and insurance but also places my family of four, including my newborn with lung disease and failure to thrive, in a precarious situation where access to insurance is vital for survival.

Working from home poses no additional cost or hardship to the VA, as thousands of employees successfully telework within the organization. Instead of terminating my employment, my supervisor could have explored alternative solutions, such as reassignment, to accommodate my needs.

This issue extends far beyond my individual case. Disability discrimination within the VA is alarmingly common, costing taxpayers nearly $200 million annually in EEO settlements. This misuse of resources not only violates the Americans with Disabilities Act and Rehabilitation Act but also detracts from the VA's primary mission of serving our Veterans and their families.

We demand immediate action:

  • Reinstatement with reasonable accommodations for all employees unfairly treated due to disabilities.
  • Comprehensive reforms to ensure strict compliance with disability rights laws.
  • Accountability measures for supervisors who perpetuate discrimination.
  • Allocation of resources towards serving veterans rather than legal battles over discrimination cases.
