Make underpayment of workers in South Australia a criminal offence!
The issue
As Victoria, New South Wales and Queensland look to amend their policies on wage theft, making it a criminal offence and giving more power to those who have been wronged, South Australia needs to reassess our policy as well.
Being someone who has been directly affected by an employer, who has underpaid all their workers with little to no consequences, we need to stand up and give more power to the workers who are truly effected by this act of blatant deception and greed.
Fair Work Australia have no power to act and mediation is a terrible form of dealing with this issue as most victims are going through a mental torment of feeling guilty, hurt and betrayal at the hands of someone they trusted.
The South Australian Employment Tribunal are just as out of touch when it comes to this - telling people that if you (a business) were being accused of this wouldn't you want your say?
Whilst this is a terrible point of view from those who are meant to be helping the South Australian people, isn't wage underpayment a black and white issue? It is written in a Modern Award, written by lawyers and by law shouldn't this be followed? These figures are fair and should be legally binding to a minimum figure - not just a suggestion.
I am not talking about the accidental errors of a couple of dollars of underpayment. I am talking about the hundreds and thousands of dollars owed to workers.
The current process is stressful and careless, aimed to help employers who choose to blatantly do the wrong thing instead of enpowering workers who have done the hard yards and made money for these greedy, power fueled law breakers.
These people need to be made an example of and this to be followed through with criminal charges and big consequences.
