Save 504 Plans: Demand Kansas Withdraw from the Lawsuit!

The Issue

On September 26, 2024, Texas Attorney General Ken Paxton filed a lawsuit (Texas v. Becerra) challenging the constitutionality of Section 504 of the Rehabilitation Act of 1973. Soon after, Kansas Attorney General Kris Kobach and 15 other states joined the lawsuit, seeking to roll back essential protections for students with disabilities.

Section 504 is a critical federal law that ensures equal educational opportunities for students with disabilities by requiring schools to provide accommodations through 504 plans. These plans allow students to receive extra time on tests, assistive technology, modified assignments, and other support they need to succeed.

Why 504 Plans Matter:

Protects Students with Disabilities – Section 504 ensures that public schools cannot discriminate against students with disabilities.

Provides Individualized Support – 504 plans help students with learning disabilities, chronic illnesses, ADHD, anxiety, and other conditions succeed in school.

Improves Educational Outcomes – Research shows that students with accommodations perform better academically and socially than those without support. (LDA America)

Covers More Students than IDEA – Unlike the Individuals with Disabilities Education Act (IDEA), which only covers certain disabilities, Section 504 protects a broader range of students from discrimination.

What This Lawsuit Would Do:

If successful, this lawsuit could eliminate 504 plans entirely, meaning:

Thousands of Kansas students could lose their accommodations in school.

Students with disabilities may face more barriers to education and participation in extracurricular activities.

Discrimination against students with disabilities could increase, undoing decades of progress in accessibility and inclusion.

Our Demand:

We, the undersigned, demand that Kansas withdraw from the lawsuit against Section 504 and protect the rights of students with disabilities. Attorney General Kris Kobach must immediately stop this attack on disability rights and ensure that Kansas schools continue providing 504 plans to students in need.

Thank you for reaching out to express your concerns regarding the attorney generals office, specifically regarding the Section 504 lawsuit. Your engagement on this matter is appreciated. The attorney general is the state's chief legal officer and top law enforcement official. As an independently elected official in Kansas, the attorney general is independent from the governor's authority outlined in the state constitution. As such, decisions related to legal actions, including the Section 504 lawsuit, fall within the attorney general's purview. Any concerns regarding the attorney general's conduct should be addressed directly to his office. Before becoming Governor, I worked as a recreational therapist and advocated at both the state and federal levels for protections against discrimination for people with disabilities. It was then that I first met with Senator Bob Dole and witnessed his relentless efforts to pass the ADA, ensuring equal rights and opportunities for Americans with disabilities. During my time as Governor, I have affirmed my commitment to disability rights by signing impactful legislation that reduces barriers, expands employment and vocational training opportunities, and supports programs intended to enhance the quality of life for Kansans living with disabilities. I will continue to fight for Kansans with disabilities to ensure they are afforded equal access to vital services and programs in Kansas.
