Relocate Terella Brewing to a More Suitable Location and Zone

The issue

We, the undersigned, respectfully request that the Sunshine Coast Regional Council:

  1. Immediately and permanently cease the operation of a tavern-like business titled as 'Terella Brewing' at 196 Bunya Road, North Arm QLD 4561.
  2. Commit to respecting the rights and welfare of families, property owners, and our precious environment.
  3. Request that the Department of Justice and Attorney-General, Office of Liquor and Gaming Regulation (OLGR), immediately revoke the liquor licence granted to Terella Brewing whilst it is operating at 196 Bunya Road, North Arm QLD 4561. 

Basis of Petition:

  • Non-compliance with Liquor Act 1992: No signage was placed on each street frontage outside the premises for 28 days, as required, notifying the local community of Terella Brewing’s liquor licence application; thereby, denying the public, particularly community neighbours, the opportunity to voice their concerns regarding the impact of such a large entertainment and liquor-serving establishment.
  • Lack of Community Consultation: Sunshine Coast Council did not communicate with locals regarding their views on the development of an alcohol-serving, band playing business in their neighbourhood.
  • Potential Risks to Neighbours and Property Owners: No consideration was given to the ongoing risks posed to neighbours and property owners in the area.
  • Environmental Impact: No environmental study was performed to assess the impacts on local flora and fauna. This area appears to be part of the Koala Habitat in SEQ Region - Core Koala Habitat Area.
  • Public Transport Deficiency: The lack of public transport options statistically increases the risk of drink driving. Records show that drink driving contributes to over 10% of traffic fatalities in Australia and over 18% in Queensland. Records show that nearly 1 in 10 drivers and riders killed on Australian roads have a BAC exceeding the legal limit.
  • Inappropriate Zoning: The area is zoned as Rural (farming, stock animals, respect for flora and fauna), with narrow and poorly finished rural roads that are now suffering as a result of the abnormal increase in traffic, which also places local users at a higher on-road risk of injury/accident (reports of alleged accidents happening at this location).
  • Incorrect Zoning: With 18 Breweries currently operating on the Sunshine Coast, Terella Brewing is the ONLY 'brewery' that has been approved in a 'Rural Zone'.
  • Sunshine Coast Council Rural Zone Identification: “Examples of development that is unlikely to be in a rural zone; Multiple Dwelling – Lowrise / Shopping Centre / Major Sport, Recreation and Entertainment Facility”.
  • Noise Breaches: Sunshine Coast Council noise regulations state:
    * 7.00am to 7.00pm: No more than 5 decibels (A) above background noise.
    * 7.00pm to 10.00pm: No more than 3 decibels (A) above background noise.
    * 10.00pm to 7.00am: No clearly audible noise.
    * Amplified devices must not exceed specific noise limits when measured from within an affected building.

Environmental Pollution Concerns:

  • Lighting and Odour Nuisances: Regulated under the Environmental Protection Act 1994.
  • Release of Contaminants: Runoff and pollution from rural and urban areas can impact waterways, regulated under the Environmental
  • Protection Act 1994. Council has jurisdiction to investigate complaints.

Inconsistent Licensing and Development:

  • The Sunshine Coast Council must move to address the many concerns around the existing definitions of 'artisan food and beverage sector licences' as they are not 'adequately encompassing' the growing brewing sector (amongst other artisan producers), and are blatantly abusing these licences for “inconsistent application of multiple land uses”. Business have allegedly been known to commence their business meeting their Artisan Licence, and later exploding to breach many conditions of this licence.
  • The current zoning and development assessment arrangements for Terella Brewing's daily activities are similar to the functions of a Tavern, and these operations are inconsistent with the requirements of the Planning Act Regulation. Terella Brewing is operating under an Ancillary to a Horticulture Licence, but engages in activities (e.g., serving alcohol and food, hosting events, playing amplified loud music, etc) that do not align with this licence.
  • There are neighbouring community concerns as to whether the current Artisan/Horticulture licence meets health and food hygiene laws, that are not having negative effects on the environment.
  • Terella Brewing appears to currently operate with functions similar to a Tavern under the authority of an Artisan Licence, granted on 30 April 2021. The approved trading hours are 10am to 12am daily for on premises consumption, and 10am to 10pm daily for takeaway sales; thereby subjecting neighbours to ongoing nonstop disturbances, a minimum averaging 4 days a week.
  • The Sunshine Coast Regional Council confirmed that town planning approval for the artisan producer business required all ingredients used in the brewing process to be sourced from the site. Unlike the former producer wholesaler licence which applied to the premises, the artisan producer approval type only allows the brewery to sell products produced on the premises and a liquor licence condition was imposed by OLGR to reflect this restriction; this regulation appears to be breached.
  • As expected, there are community concerns that Terella Brewing will apply for a licence to expand its current Tavern-like operations, further exacerbating the negative impact it is already having on the immediate neighbours, community and environment. This is reflected in their application on Sunshine Coast Council Development-i web page to change North Arm's Rural Zone to 'Medium Impact Industry Zone' - Application Number: MCU24/0279.  

Proximity to North Arm State School:

  • Terella Brewing is 1.6km from North Arm State School, and if it operates during school hours, there are community members that fear that the absence of any public transport may potentially put the lives of over 400 students and 40 staff members at an increased risk on the narrow rural roads.
  • Terella Brewing is approximately 100m from Sunshine Coast Equine Hospital: Community members fear that the Sunshine Coast Equine Hospital, currently under development and nearing completion, will potentially become another neighbour that is negatively affected by the operations of Terella Brewing's noise, odours, lights, increased traffic, and potential alcohol-related disturbances; thereby potentially posing significant risks to the hospital’s environment. This state-of-the-art equine facility requires the sanctuary and protection that North Arm’s rural zoning is intended to provide; ensuring a tranquil and safe environment for the well-being of the horses and the efficacy of the hospital's operations.

Property Value and Community Health:

  • Direct rural property prices are potentially likely to decrease due to the proximity to Terella Brewing, and  its ongoing noise, traffic congestion (and potential accidents), odours and destruction of rural peace and quiet. This is something that property owners have been exposed to through no fault of their own and as a result, the negative impact on their personal lives and wellbeing is prominent. 

In light of the aforementioned points, we assert that we do not hold any hostility or disregard for Terella Brewing. We are however, extremely unhappy with Terella Brewing's current Tavern-like operations at 196 Bunya Road, North Arm QLD 4561, as it is unsuitable for the environment, the neighbouring community and must cease immediately, relocating it to a more appropriate location and zone.
