Don't forget Planning And Zoning Commission meeting tonight at Benbrook City Hall. 911 Windscott Rd. For Rowan Ranch development adjancent Mary's Creek and 820. Doors open at 7, it will start promptly at 7:30pm. It is the 3rd item on the agenda.
What is Mr. Waldrop (developer) asking for? Last week he withdrew his' initial application so that it doesn't go for a vote at City Council. He knew he wasn't going to win a 3/4 majority vote. for it to get approved. Now he is trying to ask the Planning and Zoning Commission to wave the 12 month waiting period to submit another application and start all over. Here is the staff report quote:
"Under Section 17.12.030 of the BMC, because the applicant withdrew their rezoning application, the City is not authorized to accept a new applicationfor the same zoning classification or scheduling it for a public hearing by the Planning and Zoning Commission within twelve months of the withdrawal. However, upon receipt of a request demonstrating that substantial changes have occurred in the community since the withdrawal, the Planning and Zoning Commission may waive the mandatory delay and authorize the acceptance of a new application."
Mr. Waldrop is saying that since his' paid engineers have updated flood studies and he held a neighborhood meeting last Thursday at the library, this contitues "substantial changes have occurred in the community" !
From what I understand this is not a public hearing for this item so notice didn't need to be given. But basically if they vote to approve then it starts all over again. And they will schedule a public hearing in the future. I do not know for certain if they will allow much comments from the public. However, let's show up let them know we are not backing down! And we the community have not changed to support this development.
