Reinforce Strict Adherence to Zoning & Nuisance Bylaws for Home Based Business on Hundal

The Issue

As heavily taxed residents of Terrace, many of whom are at the proverbial wits-end with the non-compliant property in our neighborhood, we cannot stand idly as the bylaws that protect the quality of our life and environment are breached continuously. It's about the house at 4937 Hundal Dr., upon which multiple past and ongoing violations were noticed regarding AQCS (Ms. Andres) home occupation. Unfortunately, these persistent breaches have not been met with appropriate corrective action. 

We believe there are instances of complacency from the bylaw enforcement concerning the AQCS business operations. These actions and inactions have enabled and in fact are encouraging on-going, in many cases daily bylaw infractions. 

Multiple bylaws have been violated, and many continue to be violated daily, with only a few examples being, the City of Terrace Sign Bylaw - 2102 6.2.2 Nuisance Bylaw - 4 - Bylaw No. 1318-1993 (Consolidated), the City of Terrace Zoning Bylaw No. 2069 - 2014, the 2.9 Prohibited Vehicle Parking, and multiple 7.1 Home Occupation. Including operating a business within city limits, without a business licence.

Concerned and affected citizens are encouraged to file a bylaw complaint to bylaw.compliance@terrace.ca (all complaints are strictly confidential) and to sign this petition. 

Also for your informed decision and obtained under the freedom of information act, the complete and extensive bylaw file including redacted resident complaints (confidentiality maintained) past violations, homeowner refusals and repeated violations is available by emailing to: cpropertyowner@gmail.com 

These infractions have resulted in negative ongoing impacts on adjacent residents and have persisted since at least 2018 with documented proof of non-compliance and repeated offenses.

Home businesses are an essential part of our community. They encourage entrepreneurship and economic diversity. But they need to be regulated and respectful to ensure they do not become a nuisance to their locality. The day to day enjoyment of properties on Hundal Dr and adjacent Cooper Dr are being greatly impacted. As well, at minimum the immediate neighbors on all sides of the home occupation, suffer losses in home value.

We call on the By-law Enforcement Division to reconsider their overall strategies regarding these on-going violations. Effective enforcement and sufficient penalties for bylaw non-compliance are paramount to maintaining the peaceful cohabitation, protect the taxpayers home values in relation to complaint property owners, protect home owners right to enjoyment of their property and mutual respect that define our community. All under the umbrella of the highly (and ever increasing) taxed residents. 

We respectfully demand strict enforcement of the bylaws in place, as well as the thorough review of AQCS and D. Andres' business operations. It's time, after at least six years of re-occurring non-compliant behaviours for the regulations set by our city to be properly respected and upheld. The bylaw enforcement team has the tools to bring this Home Occupation into compliance, including revoking the privilege of this occupation.
