Reevaluate New York State esthetics scope determinations

The Issue

We, the undersigned licensed estheticians, educators, students, spa professionals, and consumers, respectfully request that New York State reconsider and review recent Appearance Enhancement Procedural Service Determinations that impact the esthetics profession.

 

Our concerns are not rooted in opposition to regulation, but rather in support of competency-based standards, consumer safety, educational specialization, and consistent procedural oversight.

 

Licensed estheticians receive extensive education in skin anatomy, barrier function, contraindications, sanitation, facial tissue response, cosmetic chemistry, and treatment safety. However, several recent determinations appear inconsistent in both educational alignment and procedural risk evaluation.

Many low-risk cosmetic modalities commonly performed by trained estheticians — and widely available for consumer purchase — have reportedly been removed from esthetics scope, while higher-risk procedures remain permitted elsewhere. These inconsistencies create confusion for professionals, educators, students, and consumers alike.

 

We respectfully request:

a formal review of these determinations,
greater transparency regarding procedural risk assessment,
competency-based scope evaluation,
collaboration with esthetics educators and industry professionals,
and consideration of advanced certification pathways rather than outright procedural removal.


We support reasonable regulation, public safety, and professional accountability. We simply believe regulatory decisions should accurately reflect modern esthetics education, procedural competency, and the evolving needs of both professionals and consumers.
