As an insurance agent serving clients across Kenya, I’ve witnessed a troubling and widespread issue: insured vehicle owners are losing their assets to auction—even after paying premiums and policy excess—due to claim settlement delays by insurers. This injustice stems from a gap in Kenya’s insurance enforcement laws that urgently needs fixing.

We, concerned citizens and professionals in the insurance industry, call on Kenya’s lawmakers and regulators to urgently amend existing laws to protect vehicle owners from unjust asset attachment caused by delayed insurance claim settlements.
Currently, insurance companies are legally mandated to settle claims following vehicle accidents. Yet when settlement delays occur, courts issue judgments against policyholders—even though these policyholders have paid all required premiums and excess. As a result, auctioneers are authorized to seize and sell off their personal property to satisfy the judgment.
This legal gap inflicts **double punishment** on innocent vehicle owners: they not only suffer the trauma of an accident but also lose business assets, income sources, and personal property through no fault of their own. Meanwhile, insurers remain shielded from any consequence and continue collecting premiums from the public.
We therefore demand the following legal and regulatory reforms:
- ✅ Once it's verified that the policyholder has met all payment obligations, **judgment creditors must pursue the insurer directly**, not the vehicle owner.
- ✅ **Prohibit courts from issuing warrants of attachment** against compliant policyholders.
- ✅ Enact enforceable timelines for claim settlement by insurance companies.
- ✅ Empower the **Insurance Regulatory Authority (IRA)** to monitor insurer compliance and apply penalties for delays.
