The Issue

The dire situation that the esteemed (Retd) Justice Gautam Patel of the Bombay High Court is currently facing is deeply concerning. In 2024, Justice Patel made a landmark judgement regarding a dispute of succession, ruling in favour of one of the parties involved. This decision, however, has brought upon him and his family severe consequences—death threats demanding he publicly retract his judgement, claiming it was made under pressure, and favour the opposing party.

For a figure of Justice Patel's stature, who is widely respected for his erudition and fairness, to receive such brazen threats is a direct attack on judicial independence and the rule of law. It's alarming not only because it threatens the safety of one of India's most distinguished jurists but also because it sends a chilling message to other members of the judiciary and potential judges. If a person of Justice Patel's influence can be intimidated, what hope do ordinary citizens have?

This situation undermines the very foundation of justice, trust and integrity within our judicial system. Such threats not only endanger individuals but also the essence of democracy in our nation. We cannot allow intimidation to dictate our legal processes. This is not a threat to just one man,  but to the entire judiciary and to the entire fabric of our nation.

It's essential that we, as a community, demand urgent action. We call upon the authorities to provide immediate and comprehensive security for Justice Patel and his family. Furthermore, there must be a stringent investigation into these threats, with the perpetrators brought to justice swiftly and decisively.

We must also advocate for systemic protections that ensure every judge in India can perform their duties without fear of reprisal. Judges should feel secure and supported in making impartial decisions based on the law and facts at hand.  I think it is essential that those in charge of this investigation, the External Affairs Ministry, the Chief Justice and maybe even the Home Office/Minister, need to make public statements, so that these kind of dastards cannot continue to operate in this disgustingly, horrifying way.
