Here’s a copy of this Petition to President Biden…I blocked some names & information because of Privacy Concerns

To: President Joseph R. Biden Jr.

The White House

 Dear President Biden:

Sir,

While celebrating January’s  National Human Trafficking Prevention Month, I urge you to fulfill the promises of the National Action Plan to prosecute the traffickers and to protect the victims.

Also to “expand the effectiveness in targeting human traffickers around the globe" as written in the Countering Human Trafficking Act of 2022 that you signed.

Further, I urge that your good office:

#1 Ban Philippine Ambassador-at-Large Jose "Joey" Eduardo Barata Antonio (Ambassador JEBA) DBA Century Properties and owner of the Trump Tower Philippines from participating in the United States Visa Program

#2 Declare Ambassador JEBA Persona Non Grata from the United States

because of his following Illegal activities:

a) HUMAN TRAFFICKING of foreign and local unlicensed real estate agents to sell his Philippine condominiums.

 b) SYSTEMIC VISA FRAUD and ABUSE of U.S.  IMMIGRATION PROCESS

 c) THREATS to UNITED STATES BORDER SECURITY

 d) ECONOMIC SABOTAGE to UNITED STATES ECONOMY

#3 Provide political asylum to Ambassador JEBA's trafficking victim:

“David” (not his real name who was certified by the USCIS on June 2, 2021 as a victim of severe form of Trafficking in Person (TIP)

“David” is currently residing in the United States

USCIS Approval # xxxx File # xxxx

Sir, since there is an existing Extradition Treaty between the United States and the Philippines, the USCIS TIP certification may not be sufficient to protect “David”  because of the threats from  Ambassador JEBA to file an extradition case against him

Additionally, there is the threat of Libel charge from Ambassador JEBA. Libel is a criminal case in the Philippines punishable by jail and monetary fine. The threats of Extradition and Libel are creating intense fear, torment and distress to “David”  because of the severe harm it will cause not only to him, but also to his wife and four minor children.

The ARREST WARRANT (Attachment # 1 page 1-4)

Sir, on October 26, 2022 the Makati City Philippines Trial Court issued a Warrant of Arrest Criminal Case# M-MKT-22-05685-CR because of the bogus allegations filed by the Philippine Department of Justice (DOJ) on September 15, 2022 #NPS-XV-05 INV-221-2317 accusing

“David” of Falsification of Commercial Document in June 2016.

If “David” really committed the crime in June 2016:

Why did Ambassador JEBA deploy “David” to the United States on September 30, 2016 to December 16, 2016?

Why did Ambassador JEBA renew the employment contract of “David”  in March 2017?

Why did Ambassador JEBA deploy “David”  to Japan on March 27, 2017 to April 20, 2017?

Why did Ambassador JEBA deploy “David” to the United States on May 10, 2017 to May 19, 2017?

Why Ambassador JEBA did not file a police report about the criminal incident?

Filing a trumped up criminal charge is an abuse of the legal process and weaponizing the law for what it is not designed for, but was undoubtedly filed to intimidate, retaliate against “David” after he submitted a lawful claim for his unpaid salary, commissions, illegal chargebacks and other damages.

The BOARD of DIRECTORS MEETING (Attachment # 2 page 1-5)

On September 6, 2022 the Board of Directors of Century Properties owned by Ambassador JEBA had a Special Meeting and declared that they will file proceedings against “David” before the

a) Office of the City Prosecutor

b) Department of Justice

 c) Department of Foreign Affairs

d) Bureau of Immigration

e) Internal Revenue

f) National Bureau of Investigations

g) Philippine Courts (Municipal, Metropolitan, Regional, Trial, Appeals, and the Supreme Court)

 h) International Courts

i) International Criminal Police

The members of the Board of Directors are: Jose Eduardo Antonio (Ambassador JEBA), his wife, Madam Hilda Antonio, their three sons: Jose Marco Antonio, Jose Carlo Antonio, and John Victor Antonio

Jose Roberto Antonio, their other son was also a Board member and was the managing director of the Trump Tower Philippines until he resigned in February 2021.

Former Philippine Ambassador to the United States, Jose Cuisia (July 7, 2011 to June 30, 2016) is also a member of the Board of Directors since July 22, 2016. Ambassador Cuisia served as the Governor of the Central Bank of the Philippine government.

https://en.wikipedia.org/wiki/Century_Properties

Sir, I am really worried about the threats of Ambassador JEBA to weaponize the Philippine Department of Foreign Affairs against “David” because this is the Philippine government's agency where he has a lot of influence since President Ferdinand Marcos Jr. is the third Philippine president to appoint Ambassador JEBA to the ambassador position.

Atty. Maria Elizabeth Loriega's law office, lawyers of Ambassador JEBA also informed “David”  on July 29, 2022

a) that a criminal complaint will be filed against him at the office of the Philippine Department of Justice for the June 2016 falsification of document

b) that a warrant of arrest may be issued for his immediate arrest

c) that they will coordinate with the Interpol

d) that he may be subjected to extradition and penalties of imprisonment and monetary fine

e) that based on the agreement dated March 2017 “David”  was an independent contractor and not an employee

Sir, here are more detailed information about Ambassador JEBA's illegal activities from the following sources:

1) “David” Trafficking Visa application certified and approved by the USCIS on June 2, 2021. (Only an average of 600 applications a year were approved between 2008 & 2022 and USCIS rejected 39% of the applications it processed in 2021

https://www.wgbh.org/news/local-news/2022/10/24/for-labor-trafficked-immigrants-t-visas-are-a-life-saving-but-flawed-relief

2) the sworn affidavit I submitted to the USCIS on October 6, 2020 to support “David”  Trafficking visa application (Attachment #3)

3) the July 2018 complaint I submitted to the Department of State through the courtesy of Congressman xxxx  that was forwarded by the Department of State to the Consular Section Fraud Prevention Unit. Department head was Secretary Mike Pompeo (Attachment # 4)

4) the complaint from a California Farmer's Insurance broker hired by Ambassador JEBA to work as an unlicensed real estate agent also complaints from several unhappy buyers from California who bought Ambassador JEBA's condominiums  Attachment #5 List of Demands page 1-12 Statement submitted to Department of State Diplomatic Security Service Special Agent J.L. page 1-3

5) the media news written by journalist Mr. Emil "Amok" Guillermo regarding the unlicensed agents deployed by Ambassador JEBA

https://www.aaldef.org/blog/emil-guillermo-trumps-business-partner-in-philippines-jose-eb-antonio-filipino-americans

 https://thefilipinochronicle.com/images/regular-edition/2017/HFCRE_02252017.pdf  (Attachment #6)

 a) HUMAN TRAFFICKING of foreign and local unlicensed real estate agents to sell his Philippine condominiums.

 #1 WAGE THEFT

Ambassador JEBA is well known for not paying his agents their hard-earned salaries and commissions as in the following examples:

a) current claim filed by “David” for the nonpayment of his commission and traveling expenses

b) $25K unpaid commission to a California unlicensed agent (Attachment #5)

c) change.org petition filed by several agents for their unpaid commissions

d) case filed by Ms. Emma Concepcion at the Philippine Supreme Court

e) case filed by Mr. Edwin J. Babiano at the Philippine Supreme Court

f) wage theft complaints shared with me in my Facebook messenger by several agents which unfortunately got deleted when Facebook closed my account in November 2019 after  accusing me of violating their community standards, whatever standards they were talking about.

Actually, besides his reputation for wage theft, Ambassador JEBA is also well known as a generous patron in employing celebrities to promote his luxurious condominiums.

Ambassador JEBA reportedly paid former President Donald Trump $9.3 million to use his name for the Trump Tower Philippines: he also paid an undisclosed $ amount to Paris Hilton, Gianni Versace, Giorgio Armani, Missoni, Philippe Stark, etc.

It is really ironic that Ambassador JEBA could afford to pay millions for all the branded names of celebrities while he also branded his Filipino agents with the brand of slavery! He truly built his fortune on their backs!

How does Ambassador JEBA respond to the agents’ lawful claims of unpaid salaries and commissions?

Ambassador JEBA accused some of them with criminal extortion and libel.

a) waiting for resolution at the Department of Justice is a  criminal complaint #NPS XV-052-INV-221-2316 against “David” filed by Ambassador JEBA's company on September 15, 2022 for extortion and libel

Sir, libel has been weaponized not only by the Philippine government to silence dissent but also used by powerful tycoons like Ambassador JEBA to intimidate their opponents.

UN Special Rapporteur Irene Khan condemned the Philippine court libel conviction  of Maria Ressa, the 2021 Nobel Peace Prize awardee and owner of the  Rappler newspaper

https://www.ohchr.org/en/press-releases/2022/07/philippines-un-expert-slams-court-decision-upholding-criminal-conviction July 2022

b) Latham & Watkins, Ambassador JEBA's Los Angeles lawyers accused  the complainants of extortion.  (Attachment #7 )

Ambassador JEBA uses these threats of filing extortion and criminal libel charges as a bargaining tool to intimidate and manipulate the complainants to an inferior settlement terms  for their unpaid salaries and commissions. This is another way of Ambassador JEBA’s abuse of  the legal process by creating a climate of fear.

Human Rights Watch 2023 World Report for the Philippines stated that access to justice for victims of human rights violations and abuses remained very limited...harassment, threats, arrests continue

https://www.hrw.org/world-report/2023/country-chapters/philippines

Philippine courts  known for dilly-dallying, could actually become  speedy as shown here in the drug trial of the son of current Department of Justice Secretary Remulla who was acquitted of the charges

https://twitter.com/MWinnieMonsod

https://marengwinniemonsod.ph/2023/01/07/bullet/ Re: Justice Remulla's son acquitted on January 6, 2023

“Faster Than a Speeding Bullet The amazing timeline of a drug trial

less than 3 months from arrest to acquittal...less than 75 days from trial to acquittal, in spite of so many holidays in between...that is truly a record-breaker.. thousands of detainees rotting in jail, waiting literally years for their trials to be even scheduled”

#2 LABOR TRAFFICKING OF FILIPINO AGENTS BEFORE DEPLOYMENT TO THE UNITED STATES

 a) Agents are made to issue signed checks with unfunded funds from their checking account called "Guarantee or Charge Backs" that Ambassador JEBA will use to recover deployment expenses like the cost of airfare tickets in the event that the agents do not meet their minimum sales quota. This could result in criminal charges against the agents since cashing unfunded checks is a criminal act under Philippine laws with imprisonment and monetary fines against the check issuers.

b) to discourage dissent, Ambassador JEBA retaliates by not providing employment clearance which will prevent an agent from getting another job in the same industry. His company also practices blacklisting employees.

#3 LABOR TRAFFICKING OF FILIPINO AGENTS DURING DEPLOYMENT TO THE UNITED STATES

a) The agents are not protected by labor law and they are not covered by the minimum wage, overtime, vacation pay, sick leave benefits. They lacked health insurance coverage and sometimes ended as a public charge to the U.S. overburdened public health care facilities.

b) Sometimes, the agents working in the U.S. are  paid with the Philippine, instead of the higher dollar currencies  which is another form of wage theft.

c) lack of decent accommodation since the bogus hotel bookings provided by the Philippine Amkor Travel agency  are only for show and tell to the U.S. immigration border authorities (Attachment #8); sometimes agents are sleeping in cars borrowed from U.S. based family members and friends.

Some of the agents actually got involved in car accidents without insurance coverage

#4 ALLEGATIONS OF SEXUAL TRAFFICKING

Besides labor trafficking, there were also allegations of sexual trafficking when xxxx (AKA xxxx), a bold star and a member of a group known as xxxx, was sent to Hawaii and California to promote and sell luxurious condominiums.

Ambassador JEBA is really part of the reason why Filipinos are becoming more and more the face of modern slavery.

 b) SYSTEMIC VISA FRAUD and ABUSE of U.S.  IMMIGRATION PROCESS

1) Use of a 10 year multiple entry B1 and B2 visa instead of the more expensive H-IB visa that provides the agents work authorization

Infosys owned by Mr. Murthy, father-in-law of PM Rishi Sunak, the current British Prime Minister had to pay a $34 million fine to the U.S. government

https://www.ice.gov/news/releases/indian-corporation-pays-record-34-million-fine-settle-allegations-systemic-visa-fraud “Indian corporation pays record $34 million fine to settle allegations of systemic visa fraud and abuse of immigration processes”

The H-IB visa protects American workers from unfair competition with workers from other countries that pay lower wages. The H-IB visa also protects Ambassador JEBA's foreign agents since he will be required to pay them fair wages.

Undeniably, misuse of visas for competitive advantage harms not only the local businesses, but also the American and foreign workers.

Agents deployed by Ambassador JEBA to the United States are truly human trafficking victims because if caught working against the condition of their visa they may be subjected to arrest, imprisonment, deportation and ban. The agents are also made to perform illegal tasks like processing credit card transactions for Ambassador JEBA’s real estate business

2) submission of knowingly falsified statement:

a) employment title and salary

The U.S. Embassy in the Philippines is the ground zero for Ambassador JEBA's deployment activities; an investigation must be done to find out how many International Marketing Directors (IMD) he sent to the United States. There were also allegations that visa applicants paid Ambassador JEBA's company for bogus employment verification

b) submission of bogus bank statements with deposits that need to be  returned by the agent to Ambassador JEBA's company after verification by the U.S. Embassy in the Philippines

c) Dummy hotel bookings by Amkor Travel agency  (Attachment #8 )

d) bogus Letter of Guarantee for sixteen agents signed by Atty. xxxx, the former corporate lawyer of Ambassador JEBA (btw, Atty. xxxx now works for the xxxx law office in Houston Texas https://xxxx stating:  Dear Immigration officer: “let this letter serve as a guarantee that the following personnel will diligently observe all rules and regulations of the immigration of the United States of America upon their entry” (Attachment #11)

President Biden, these are the same unlicensed agents who were made to illegally sell Ambassador JEBA's condominiums

Atty xxxx also misrepresented that Ambassador JEBA's company will pay for all of the agents expenses, but actually the agents had to rely on the charity of their  friends and  relatives to provide lodging for them. https://www.aaldef.org/blog/emil-guillermo-trumps-business-partner-in-philippines-jose-eb-antonio-filipino-americans/

https://thefilipinochronicle.com/images/regular-edition/2017/HFCRE_02252017.pdf (Attachment # 6)

 3) Deployment Briefing

Agents were taught how to lie to the U.S. port of entry officers about the real purpose of their stay like claiming to visit family, to dance and entertain in Filipino cultural shows, etc. when in reality Ambassador JEBA deployed them to sell his condominiums (Attachment #5 )

 c) THREATS TO UNITED STATES BORDER SECURITY

There are serious border security concerns in granting 10 year multiple entry visas to Ambassador JEBA's agents since the Philippines is known to be a hotbed of terrorism and insurgency. Constant multiple entries, departures, reentries of Ambassador JEBA’s agents should be under scrutiny.

                           d) ECONOMIC SABOTAGE to UNITED STATES ECONOMY

Philippine President Duterte appointed Ambassador JEBA to the United States as  the Ambassador for Trade, Investment and Economic Affairs, but instead he conducted economic sabotage

 1) Tax Evasion thru Conspiracy

Ambassador JEBA was able to develop a network of underground or informal economy by conspiring with the Filipino American communities. He hires accountants, insurance, real estate agents and brokers as the unlicensed agents to sell his condominiums. These irregular transactions defraud the Federal, State and local government of taxes that should be paid to them. This conspiracy  creates unjust enrichment for Ambassador JEBA

 2) Money Laundering

$71,779.39 cash paid by xxxx, a buyer from California

This cash was divided among several agents to escape scrutiny when exiting United States Attachment # 9 a) Photo of cash  b) Receipt of cash given to agents

3) Unfair Business Competition to the U.S. Real  Estate Industry

To maximize his corporate profit, Ambassador JEBA created an uneven playing field for U.S. legitimate real estate industry that needs to comply with the government regulations regarding taxes, workers, consumer protections, etc

How can local businesses compete with Ambassador JEBA who does not pay Social Security, workmen's compensation, unemployment, health, disability insurance and does not observe the Federal and State minimum wage regulations?

4) Lack of Consumer Protection to U.S. buyers of Ambassador JEBA's condominiums

Most  Filipino American buyers of Ambassador JEBA’s condominiums are purchasing the units  for investment and relying on the rental income from transactions brokered by Ambassador JEBA's property management company which manages these units for a fee, but these transactions sometimes turn into financial disaster when the turnover of the unit is delayed and no rental  income was generated and the buyers signed postdated checks were already cashed

Another sales pitch to entice buyers is the classic “it would be easy to flip” but then took many months for the units to sell

There was also the problematic property title transfers

Some of the units are defective, lack electricity, filthy, used when described as new units

There are also some Issues with the property management company owned by Ambassador JEBA

Properties foreclosed were resold by Ambassador JEBA.

The following buyers from California had filed complaints: (names of 9 buyers) (Attachment #5 )

Several buyers are also  known to have filed complaints at the California Board of Real Estate without success because of the ambiguity of law regarding court jurisdiction issues and the complexity of sales contracts signed in the United States with the properties located in the Philippines.

Many buyers have given up claims to legitimate financial damages because of lack of access to lawyers who are licensed to practice both in the United States and in the Philippines.

I know of an elderly couple that gave up after paying $5K retainer’s fee to an American lawyer who spent many hours trying to negotiate with Ambassador JEBA’s  Philippine lawyers with frustrating delaying tactics. I also assisted the couple in filing complaints to the California Board of Real Estate to no avail. (Complaint Reference PC # 4 - 18-1029-005). Unfortunately, they also lost the money they had already paid to Ambassador JEBA.

California’s Montefalcon Law office responded to threats of filing extortion against their clients that the demand is for the damages caused to their client and it is not blackmail or extortion   (Attachment #10)

ON-GOING U.S. DEPLOYMENT OF UNLICENSED AGENTS

In addition to the deployment of agents I already reported to the Department of State, I received  information about the following agents

Mr. xxxx  was sent to Hawaii in April 2022; February 2022; September 2021 and from Dubai UAE to New York in July 2021

Mr. xxxx arrived in Los Angeles with xxxx  and Mr. xxxx. Mr xxxx rented a car at LAX Thrifty from July 1, 2021 to July 10, 2021 receipt #109432960

Ms. xxxx (AKA xxxx) Mr. xxxx and Mr xxxx arrived at the John Kennedy International Airport on December 27, 2019

xxxx was sent to California in December  2018

Mr. xxxx  arrived in NY from Manila April 28, 2018

Mr. xxxx  in San Francisco California in April 2018

Ms. xxxx was deployed to the East Coast on February 23, 2018 to May 2018

Mr xxxx and his sister xxxx  was in New York in April 2018

Mr xxxx  team of agents was in Chicago in May 2018

Mr. xxxx arrived on February 23, 2018

Mr. xxxx  arrived in  New York from New Zealand on April 13, 2018

I would  have more information, but after Facebook closed my account, I lost contact with the Overseas Filipino Workers (OFWs) since most of them are using  facebook only. The U.S. Embassy in the Philippines should have plenty of paper trails about these deployments that are another example of human trafficking in plain sight.

HOW POWERFUL IS AMBASSADOR JEBA?

Ambassador JEBA was appointed to his government  position by three Philippine Presidents

In the Philippines, where he licensed his name to a Manila tower nearly a decade ago, the low end of the range was $4.1 million — less than half of the $9.3 million he actually made....

It did not take long for conflicts to emerge when Mr. Trump ran for president and won. The Philippines’ strongman leader, Rodrigo Duterte, chose as a special trade envoy to Washington the businessman behind the Trump tower in Manila

The Court of Tax Appeals First Division Quezon City Philippines CTA cases #8969 EB #1826 EB #1830 promulgated 11/18/2019 court filings mentioned the business partnership of Trump Marks Philippines LLC owned by President Trump and Century Luxury Properties Inc/Century City owned by Ambassador JEBA.

(notes by M.E.Embry 1/19/2023 source was in pdf form...I'm kinda low tech so I just copied and pasted here the following): REPUBLIC OF THE PHILIPPINES Court of Tax Appeals Quezon City FIRST DIVISION COURT CALENDAR FOR TUESDAY, JULY 14, 2015

Media reports on the recently released copies of President Trump tax filings for 2015-2019 stated that in 2017 he paid $750 to the U.S. government compared to the $156,824 tax he paid to the Philippine government and in the licensing deal/royalty payments he earned $9.3 million.

Century Properties SEC FY 2019 reported the Trump Tower Philippines as a $150 million 57 story building of 267 units that was completed in 2017

 https://www.vox.com/2020/9/28/21459803/trump-taxes-nyt-foreign-business-national-security

(Pres Trump) also received cash from countries crucial to the global affairs objectives of his administration, like $3 million from the Philippines

The tax  returns also show that Trump’s empire garnered more revenue from abroad than previously known. Over the past two decades, for example, Trump.....agreement in the Philippine capital of Manila was worth $9.3 million

b) MITSUBISHI JAPAN (Attachment Photo #5a-5b)

Ambassador JEBA went into partnership with Mitsubishi Japan to build the Forbes Media Tower, the world's first Forbes branded building. He is also building with Mitsubishi, PHirst Park Homes, a 33K homes project valued at $57 Billion

Ambassador JEBA also owns a building management company that manages many buildings including the Singapore Embassy

Indeed, Ambassador JEBA is a very powerful man, but he abused and continually abused that power and must be stopped. He continually abuses the legal process by using it for an improper purpose when he maliciously prosecuted

“David”  a whistleblower and is now inflicting further injury to him which is contrary to the law, morals and public policy of the United States

Holding Ambassador JEBA accountable will send a strong message to the world that human trafficking is a serious crime against humanity

President Biden, your intervention is urgently needed because Ambassador JEBA is not only a very powerful person, but also very determined to crush“David”, the whistleblower against his illegal activities.

“David” cooperated with the 2017  investigation conducted by Department of State Special agent J.L, met with him, talked with him on the phone, exchange emails, submitted to interviews until Mr J.L. closed the investigation on September 5, 2017 without informing “David”

why his communications to him on July 10, 2017 that the U.S. Attorney’s office is interested in talking to “David”, which btw, did not occur. (Attachment #12)

Although I plead for “David” asylum however, the totality of my plea is not only for him, but also for all the other victims of Ambassador JEBA.

xxxx is similar to David, fighting for his survival and Ambassador JEBA is the Goliath about to crush him.

President Biden, you appointed the U.S. Ambassador-at-Large Cindy Dyer to the office of Monitor and Combat Trafficking in Person (https://statenewswire.com/stories/638894168-u-s-ambassador-at-large-to-monitor-and-combat-trafficking-in-persons-cindy-dyer-s-travel-to-the-republic-of-korea-and-japan

Sir, I hope you agree with me that it would be kinda weird for her to be engaging Philippine Ambassador-at-Large JEBA on the issues of human trafficking.

Ambassador JEBA needs to be stopped!

But, because Ambassador JEBA enjoys the privilege of diplomatic immunity then he should be declared persona non grata from the United States because it doesn’t really matter how many trafficking victims are rescued, but if the traffickers like Ambassador JEBA are left unpunished, the anti human trafficking campaign will not be successful.

Sir, thank you for your attention to this matter

Ambassador JEBA was appointed to his government  position by three Philippine Presidents

a) In 2022 he was promoted  to the position of Ambassador-at-Large by President Ferdinand Marcos Jr. (Attachment Photo #1)

c) He was appointed Special Ambassador to China by President Arroyo (2005-2008)

https://www.nytimes.com/interactive/2020/09/27/us/donald-trump-taxes.html

COMMISSIONER’S HEARING: 1. TRUMP MARKS PHILIPPINES LLC versus CTA Case No. 8969 COMMISSIONER OF INTERNAL REVENUE

PC: Atty. Catherine Beatrice O. Kingkay (notified) RC: Atty. Lorna SB. Cruz (notified) (Before Atty. Leizl L. Calimaran-Soriano, Executive Clerk of Court II, at 1:30 p.m.)

He is also building with Mitsubishi, PHirst Park Homes, a 33K homes project valued at $57 Billion

c) MR. KAZUO OKADA

Ambassador JEBA was a former business partner of the Japanese gaming tycoon

 d) MR. DENNIS UY (Attachment Photo #6) also listed at the Forbes Richest, their partnership is located at Clark Global City in the former U.S. military facility

https://news.abs-cbn.com/business/01/21/19/century-dennis-uy-to-form-joint-venture-for-clark-global-city-project
