Pass Federal law that mandates any Officer-Citizen shooting immediately be transferred and investigated by a bipartisan outside third party agency.

The Issue



     As citizens we realize at times the use of deadly force is necessary by uniformed Peace Officers.  Peace officers place their lives on the line every day, to protect the public.  The use of deadly force was set in precedent by the United States Supreme Court in Tennessee v. Garner 471 U.S. 1, 105. 1964, 85 L. Ed 2d 1, 1985 U.S. Our concern is not at what time deadly force can or cannot be used, but rather how an Officer on Citizen shooting is investigated, when that shooting results in injury or death.

    As we all know Officer on Citizen shootings  have been on the rise tremendously in the last few years all across the United States. Therefore, what we as citizens are questioning, is at the time of an Officer on Citizen shooting, should the investigation of the shooting be allowed to remain “in-house” and investigated by his/her own employing police agency?  How can a victim of a police shooting get a fair and unbiased investigation , if the individual(s) who are investigating have constant daily contact with the Officer involved?  This includes fellow Officers, Prosecutor's, Judges, and Superiors.  The truth of the matter is; the victim cannot get a fair investigation so long as the investigation remains within the officer is questions department.

      Therefore, we the Citizens of the United States hereby and respectfully propose Samantha's Law: The Citizens of the United States propose Federal Law be established pertaining to how a Peace Officer on Citizen shooting resulting in injury or death is investigated. Under no circumstances should a Peace Officer on Citizen shooting investigation remain "in-house". Any officer- civilian shooting should automatically and immediately be transferred and investigated by a  outside third party agency.  This allows fairness to both parties involved, and disallows favoritism to either party. Justice cannot properly be served, while this selfish act continues to occur. The law should be adjusted as such to protect both the citizens of the United States and to protect the integrity of the many Law Enforcement agencies across the country.
