We, the undersigned, are deeply concerned citizens of British Columbia addressing a critical failure in our education system's commitment to inclusivity and equal opportunity. This petition is inspired by the case of Daniel Gardner, a child with multiple disabilities who has been denied timely entry into kindergarten despite his mother's persistent communication with the school district for over six months.
This situation highlights a systemic issue that contradicts not only the principles of inclusive education that our government claims to uphold but also violates specific provisions of the BC School Act:
- The Canadian Charter of Rights and Freedoms guarantees every individual the right to equal benefit of the law without discrimination.
- BC Human Rights Code prohibits discrimination based on disability in public services, including education.
- The BC School Act, in Section 2, states that the purpose of the British Columbia school system is to "enable all learners to become literate, to develop their individual potential and to acquire the knowledge, skills and attitudes needed to contribute to a healthy, democratic and pluralistic society and a prosperous and sustainable economy."
- Section 3 of the BC School Act entitles every school-age person to enroll in an educational program provided by the board of education, which includes students with special needs.
- The government has repeatedly expressed commitment to inclusive education and support for students with special needs.
Yet, the reality faced by Daniel and potentially many other children with disabilities reveals a troubling gap between these legal requirements, promises, and their implementation. This discrepancy raises serious questions about the allocation of resources, the reduction of educational assistant hours, and the overall commitment to supporting students with special needs.
Call to Action
We, therefore, call upon the Minister of Education and the Government of British Columbia to:
- Provide an immediate and clear timeline for Daniel Gardner's full-time school entry, ensuring he receives the necessary support, in compliance with Section 3 of the BC School Act.
- Explain the rationale behind cutting educational assistant hours across the province when the need is evidently increasing, and how this aligns with the purpose of the school system as defined in Section 2 of the BC School Act.
- Clarify the allocation and use of funds specifically designated for supporting students with special needs upon their school registration, ensuring compliance with the BC School Act's mandate for equitable access to education.
- Develop and implement a comprehensive plan to address the systemic issues preventing truly inclusive education in British Columbia, in line with the BC School Act's requirements and the principles of the Individual Education Plan (IEP) process outlined in the Act.
- Commit to regular, transparent reporting on the progress of inclusive education initiatives and the support provided to students with special needs, demonstrating adherence to both the letter and spirit of the BC School Act.
- Review and strengthen the enforcement mechanisms within the BC School Act to ensure that school boards are held accountable for providing timely and appropriate support to all students, including those with special needs.
We believe that a society is judged by how it treats its most vulnerable members. It's time for our education system to live up to its legal obligations under the BC School Act and truly serve all students, regardless of their abilities.
