NO VACCINE MANDATES OR PASSPORTS!

Whereas, under the American system of separation of powers, no official or agency of an executive branch in any jurisdiction can enact laws, which is the exclusive province of each legislative branch;

Whereas, the executive may enact temporary powers only upon declaration of an emergency and only until the legislature can act to represent the whole people;

Whereas, the legislature of each jurisdiction has the immediate duty to review and then revoke, revise or confirm any emergency decision by the executive, a responsibility too few legislatures are fulfilling;

Whereas, Covid-19 has been declared a continuing “public health emergency” by state executives and public health agencies, enforced through business and professional licensing boards with disciplinary authority limits they are asked to exceed, although CDC records show very high case recovery rates consistent with typical rates for annual seasonal influenzas that do not justify designation as a public health emergency:
99.99% for ages under 18;
99.86% for ages 18-49;
99.81% for ages 50-64;
95.38% for ages 65-74;
84.4% for ages 75 and older;
98.3% for the total population;

Whereas, PCR tests of asymptomatic people using varying cycle threshholds, arbitrary significance criteria, and uncertain procedural reliability have been used to maintain a false narrative of a continuing “pandemic”;

Whereas, the PCR test was not designed by its Nobel laureate inventor, Kary Mullis, to detect disease, and has been closely scrutinized and ruled invalid as a diagnostic instrument by courts in Portugal, Austria, Germany and the Netherlands;

Whereas, the social isolation and economic lockdown measures have been devastating and far more damaging than the virus, and we intend to support strong civil and criminal legal remedies if necessary; lawsuits have been filed against European governments and the WHO charging “crimes against humanity,” against the Drosten test instrument developer for an “invalid and misleading PCR diagnostic test,” and against the CDC and DHHS charging use of fraudulent and deceptive data to deceive the public;

Whereas, well-established early treatment protocols for other conditions have been proven highly effective for Covid-19, which invalidates the FDA’s Emergency Use Authorizations for Covid-19 vaccines since EUAs can only be issued when effective FDA-approved treatments are not available;

Whereas, no medical procedure can be mandated without FDA approval;

Whereas, these vaccines are still experimental using insufficiently tested technology, with Phase 3 trials barely underway that are scheduled for two years, and FDA approval cannot be granted until these are completed;

Whereas, CDC’s Vaccine Adverse Events Reporting System as of May 15, 2021 had recorded 4,057 deaths, 2,277 permanent disabilities, 1,262 heart attacks, 11,227 severe allergic and anaphylactic reactions, 275 miscarriages, and 939 incidents of potentially lethal thrombocytopenia following Covid-19 vaccinations; in less than five months, the deaths alone are already some 20 times greater than the consistent average annual VAERS reports for the last 30 years;

Whereas, no medical procedure can be mandated by government without informed consent under the Nuremberg Code; this must include notification of blanket legal protection for any vaccine injuries caused by the manufacturers, providers, and government, all immunized from liability by the February 2020 Public Readiness and Emergency Preparedness (PREP) Act;

Whereas, no one can be required to disclose personal medical information;

Whereas, in view of the above facts and restrictions, governments are attempting to informally deputize private businesses and citizens to force what they cannot legally enforce upon the public;

Therefore, we call for a permanent injunction against both vaccine mandates and “vaccine passports” which would legalize discrimination on medical status, permitting unconstitutional abridgments of civil rights and freedoms to engage in commercial, educational, recreational and other public and private social activities, violating inter alia our First Amendment right of assembly, our Fourth Amendment right to security of person, our Fifth Amendment right to due process, and our Fourteenth Amendment rights to protection of life and liberty from government without due process of law and equal protection of law should any rights be made conditional on vaccination status.

             We say No! No vaccine mandates! No vaccine passports!
