Petition Against Upcoming Pub Which Is Violating Rules and Norms

Background:

HAL 3rd stage, Indiranagar is a residential area as per the RMP.  Living in HAL 3rd Stage, Indiranagar, Bengaluru, is a source of pride for its residents. We cherish the peace and wellbeing of our neighborhood. 

A new pub / bar, YU Restobar / Pangeo, with an approved seating capacity of 299 PAX (as per the sanctioned plan) is under construction at 44-45, 80 ft road, Indiranagar, right behind our residences. The proposed opening of YU resto bar is alarming and unacceptable to us. Our community, replete with families, seniors, and children, will face huge issues from the opening of such an establishment in a primarily residential area.

Our Objections:

Following are our concerns:

  1. Indiranagar is a residential layout as per RMP.  Setting up a huge establishment like this in our neighbourhood, will alter the its residential nature. We fear that the influx of customers and vehicles will lead to setting up of many ancillary services to support these vehicles and will alter its residential nature.
  2. Violations against sanctioned plan: The construction deviates from the sanctioned plan on many counts. Specifically
    - There are no setbacks and at places it is abutting the residences.
    - There is no provision for car parking on the premises and the car parking area has been converted for commercial use.
  3. Violation of rule 5 of excise act : The proposed establishment is at a distance of less than 100m to prestigious National Public School Indiranagar, which was established in 1982.  We would like to bring to your notice that this is in gross violation of Rule 5 of the Karnataka Excise Licenses (General Conditions) -1967.
    Rule 5 regulates the issuing of licences to liquor outlets stating: "No license for sale of liquor shall be granted to a liquor shop or premises selected within a distance of 100 metres from any religious or educational institution or hospital or any office of the state government or central government or local authority, or in a residential locality, where the inhabitants are predominantly belonging to Scheduled Castes or Scheduled Tribes or within a distance of 220 meters from the middle of the state highway or national highway”.
  4. Oil, smoke and sound pollution from the chimney: Chimney is pointing in the direction of the residences. Sounds, oil and smoke will be let out in the direction of the residences which is not permitted.
  5. Non-existent car parking: With an official seated capacity of 299, we can expect at least 100 cars to enter the building. The planned car park capacity of 6 (which is non-existent on the ground) is woefully inadequate to handle this vehicle volume. We fear that the vehicles will enter our by lanes and park all over our residential layout, leading to nuisance for us.
  6. Sound Pollution: 299 patrons or more, will definitely lead to a lot of noise and nuisance. The entire structure is open and we see no provision for soundproofing .
  7. Fire Hazard: With the car parks used for commercial activity and the narrow exits, the establishment poses serious fire hazard to both neighbours and patrons. 
  8. Health hazard due to no setbacks: Lack of setbacks exacerbates the health hazards posed to residents due to presence of rats, vermin's etc.

By signing this petition, you stand with us—residents of HAL 3rd Stage, Indiranagar in urging relevant authorities to deny approval for the YU resto bar. Let us protect our community's integrity and ensure a safe and harmonious living environment for all.
