Oppose HB 3838 – Protect Community-Based Care

The Issue

HB 3838 gives unprecedented rulemaking authority to a new board that could impose sweeping staffing mandates on community-based care providers.  

  • Providers would lose the flexibility to design wages, schedules, and working conditions that reflect the unique needs of both staff and the individuals they serve.
  • The board would only consider impacts on caregivers, while providers must balance the needs of caregivers and the people they serve.
  • Rules imposed by the board could force many facilities to close or drastically reduce services.
  • Adding a new board on top of existing regulatory structures would significantly increase confusion and administrative burden. 

Providers need funding and stability to plan, operate, and deliver care effectively. An unpredictable and ever-changing regulatory landscape makes it nearly impossible to sustain high-quality services.

We don't need to the state to spend money on a new board. What we need is meaningful state investments in aging services.
