

Protect the Rights of ALL Native American Artists Uphold the Indian Arts, Crafts and Sales Act
The Issue
Please support Native American artists by signing our petition to repeal Oklahoma HB 2261, which makes it illegal for two-thirds of ALL Native artists to sell their work as “Indian” produced in the state of Oklahoma.
On June 8, 2016, Governor Fallin of Oklahoma approved HB 2261, amending the Indian Arts and Crafts Sales Act of 1974, thus ultimately undermining the Indian Arts and Crafts Act of 1990 (P.L. 101-644).
HB 2261 struck language in the Sales Act, narrowing the definition of American Indian tribe and American Indian, so that only those artists who are enrolled in a Federal tribe can offer their art for sale as “Indian” made in the state of Oklahoma.
Under the Federal Indian Arts and Crafts Act of 1990, “Indian” is defined as:
1) A Member of a federally recognized tribe 2) A Member of an officially State recognized tribe 3) A Certified Indian artisan (Certified Indian artisan means an individual who is certified by the governing body of an Indian tribe as a non-member Indian artisan).
HB 2261 is contrary to the Federal Act. It not only affects two-thirds of all “Indian” artists and their livelihood, HB 2261 affects commerce in the state of Oklahoma, as well as interstate commerce, violating the Commerce Clause of the U.S. Constitution and various U.S. Supreme Court cases.
