The Issue

INTRODUCTION:  

Many transgender individuals in Malaysia, particularly non-Muslims who have undergone sex reassignment surgery, continue to face significant challenges due to the government's refusal to allow changes to their National Registration Identification Card (NRIC). This denial forces them to live under their previous gender identity, leading to confusion and discrimination in various aspects of life, including education, employment, healthcare, and social interactions.

This lack of recognition of their true gender results in ongoing emotional and mental distress. Transgender individuals are compelled to navigate a world that does not acknowledge their authentic selves, which undermines their well-being and quality of life.

‘’Gender recognition is a fundamental human right’’ that allows individuals to live in accordance with their true identity. It is crucial for the Malaysian government to grant transgender individuals, particularly non-Muslims, the right to amend their NRIC details, including their name, gender, and identification number (last digit). Legal gender recognition plays an essential role in reducing the stigma and discrimination the transgender community faces and allows them to live with dignity, free from unnecessary barriers.

LEGAL FRAMEWORK:

Although there is no specific law in Malaysia protecting the rights of transgender individuals, the Federal Constitution provides a strong legal foundation that safeguards the rights and freedoms of all citizens, regardless of gender identity. Several articles of the Constitution support this:

Article 5 - Guarantees the right to personal freedom, which includes the right to live with dignity.

Article 8 - Emphasizes equality, ensuring that no one is discriminated against on the basis of gender identity.

Article 9 - guarantees freedom of movement.

Article 10 -  protects freedom of expression.

Despite the Constitution's guarantees, transgender individuals are still required to obtain a court order to amend their NRIC details, as outlined in - Jabatan Pendaftaran Negara (JPN) Directive No. 9/2007. This process is unnecessarily complex, and in many cases, it delays or denies individuals the recognition they deserve.

LEGAL PRECEDENTS:  

Historically, changing one's gender in the NRIC was more straightforward. In 1997, psychiatrists were allowed to submit letters to the JPN after assessing the psychological readiness of individuals, leading to changes in their NRIC details. However, following the implementation of a federal fatwa, stricter regulations were imposed, making it harder for transgender individuals to change their gender marker.

While the current process requires a court order, recent legal cases show that change is possible. In **Tan Pooi Yee v Ketua Pengarah Jabatan Pendaftaran Negara [2016] MLJU 825**, the court recognized the plaintiff’s right to amend his NRIC details after undergoing sex reassignment surgery. Similarly, in **Re JG, JG v Pengarah Jabatan Pendaftaran Negara [2006] 1 MLJ 90**, the court ruled in favor of a transgender woman seeking to change her gender marker to reflect her identity.

These cases illustrate that while the process has become more stringent, it is not insurmountable. The NRIC is a vital document that affects nearly every aspect of life, and it is crucial that the government reevaluate its policies to allow transgender individuals to live in accordance with their gender identity without undue hardship.

THE NEED FOR CHANGE:  

The fatwa that governs gender changes primarily applies to Muslim individuals, while this petition focuses on the rights of non-Muslim transgender individuals. Therefore, it is essential for the government to recognize the need for a separate, less restrictive process that allows non-Muslim transgender individuals to amend their NRIC details without requiring a court order or a government hospital letter.

The current process places an unfair burden on transgender individuals, who already face significant societal stigma and discrimination. Allowing them to change their NRIC details more easily would help them navigate life without unnecessary obstacles, reduce mental distress, and promote a more inclusive society.

DEMAND:  

We, the undersigned, urge the government of Malaysia to:

1.Amend the regulations governing NRIC changes** to allow transgender individuals, particularly non-Muslims, to amend their name, gender, and identification number without requiring a court order or a government hospital letter.

2.Simplify the process** for transgender individuals to reflect their true gender on official documents, ensuring they can live in accordance with their identity.

3.Recognize the rights of transgender individuals** as fundamental human rights protected by the Federal Constitution, specifically the rights to personal freedom, equality, and dignity.

4.Promote inclusivity and understanding** by revising outdated policies that discriminate against transgender individuals, paving the way for a more compassionate and equal society.

CONCLUSION:  

This campaign aims to raise awareness and advocate for the rights of the transgender community in Malaysia. Legal gender recognition is a basic human right that should be accessible to all individuals, regardless of their gender identity. By allowing transgender individuals to amend their NRIC details without undue barriers, the government can help create a more inclusive and equal society for all Malaysians.
