Keep Aviara Lot 10 zoned for recreation and not residential

The Planning Commission is recommending that the Carlsbad City Council change the zoning of Lot 10 (at the intersection of Batiquitos and Kingfisher Ln) from recreational use to residential use.  This area is presently a grassy park/open space area.  It is designated in the Aviara Master Plan as a sports center for residents. The objective of this petition is to ask the Mayor and City Council to leave Lot 10 zoned for recreation and not for residential.

This 10.6 acre lot could theoretically support up to 15 dwelling units per acre for a total of 159 dwelling units.   More dwelling units could be built if the lot is designated high density.  Not only will the building of these residences reduce our open/recreation space, it will increase traffic and noise along Batiquitos, signficantly increase housing density in Aviara, potentially lowering property values, and cause additional crowding in our already burdened local schools.

Here is some background on the topic.

The city of Carlsbad has circulated "Envision Carlsbad Land Use Concepts" with three concepts. Two of these concepts call for changing the zoning of Aviara Lot 10 from recreational use to either high-density residential (Concept A) or low-density residential (Concept B).

The owners of this parcel (Aviara Resorts Associates) are the owners of the Park Hyatt Hotel. They are actively lobbying the City of Carlsbad to convert the zoning of this parcel to residential, with a stated preference for medium or high-density residential. Here is an excerpt from their letter to the city:

"The parcel in question is [APN 215-592-04 and 28] at the intersection of Kingfisher Lane and Batiquitos Drive. This parcel is currently zoned commercial/recreation and designated in the Aviara Master Plan for a sports club and restaurant site. We and our partners have been involved in the Resort since it was first under construction. This particular parcel has never been developed because a sports club and restaurant have been demonstrated to be not financially viable in this location and we have not found other commercial or recreation uses for it that are appealing investments. As such, we are very supportive of the City's initiative to consider other uses for the site.

Two of the three concepts put forward by the Envision Carlsbad Land Use Concepts would change the site's use to residential. The third plan does not change the land use. We support the change to residential use because commercial is not financially viable on this site. Of the residential options, we would be most supportive of Medium Density residential as we believe that amount of density would be compatible with the resort and time share buildings already existing on the campus. Alternatively, we would also support high density followed by low density in order of preference"

The Planning Commission on 5/16/2012 stated that they are recommending a change in zoning of Lot 10 to residential.  No consideration has been given to residents of Aviara.
