My son was killed in a motorcycle accident in 2021. His body was subject to post-mortem tests and examination. He had no choice in which tests were conducted. The driver of the vehicle that pulled out of a side street was tested for alcohol. He was charged with driving at a BAC level of 0.0780. He was not subjected to a drug test yet his victim was, and, as are all deceased in motor vehicle accidents. It is not Mandatory in QUEENSLAND to test all parties involved, it is at the discretion of the attending police, yet the deceased have no choice.

Driving a motor vehicle with a BAC OF 0.04 is legal, however, if combined with marijuana can result in an effect equivalent to BAC level 48 times greater (approx 0.12).

The law needs to be changed to ensure justice for the deceased is served. Should the law not be changed, the true state of all parties is not presented to the court.
