Mandate Social Media Platforms to be Transparent with Creators
The Issue
It's a very simple problem to explain, because it happens all the time. If you're a content creator on a social media platform, perhaps your account has been suspended or even banned outright, and you have no idea why, and worse yet you have no recourse against the platform that has taken action against you. If you're a viewer, maybe a channel you have loved for years suddenly goes dark. When the audience is confused, that's one thing. But if the creator themselves are in the dark about why it happened, that is a problem. The solution is simply this: Make the platforms be transparent with their creators! Without creators, social media platforms would be a nonstarter.
When a creator is deplatformed for a legitimate cause, either public or private, that makes sense: maybe the creator was defrauding their viewers, or advocating illegal activity, or of course actually violating community guidelines in a way that would lead a reasonable person to think "ah, ok, I get that"... But if you are a content creator, or know/follow many creators, you no doubt have seen the constant reports of bans and suspensions - on YouTube, Instagram, TikTok, and other platforms - that seem to have no basis in fact or reality... or, at least, none that the creator is made privy to.
This petition is not out to save channels that are deplatformed for actual cause; rather, this petition is to create a legal mandate that serves as a foundation for what many believe should exist as a Creator's Bill Of Rights, for lack of a better term, as a generalized measure to avoid incorrect, unfair and inappropriate treatment of Social Media account holders by the institutions that grant said Accounts. This call for a mandate - basically a proposed Bill to eventually be signed into law - is put forth with the following components and stipulations (note: for brevity, the company to which the Social Media account is owned or attributed, or their representative, shall hereinafter be known as Platform, while the account-holder or content creator shall be known as Creator):
- Any and all potential channel/account bans/suspensions are to be brought to the creator by an actual human representative of the respective Platform, in writing, via the contact information of record for the Creator, as a written warning at first with an ensuing period during which person-to-person discussion between the Creator and Platform is made available before the ban or suspension is enacted.
- The Platform shall inform the Creator of the following:
- The specific Community Guideline or Rule violation(s) that the Creator is accused of breaking, in as much detail as is available to the Platform
- The specific item of Creator's content - be it a textual message, image, video, or any other type of media - that is in question regarding said Rule violation
- The exact portion within the allegedly-infracting item of media identified in 2.2 which is claimed to be infracting of the Guideline or Rule stated in 2.1 - this is to include annotated portions of images and specifically-timestamped portions of audio or video media.
- A detailed account of how or why the alleged infracting media is, in the eyes of the Platform, a violation or infraction of the Guideline or Rule in 2.1.
- The Platform shall allow the Creator one or more rebuttal statements to any and all infractions within a reasonable amount of time. This amount of time shall not be less than 72 hours from the informing communication outlined in section 2 above.
- Platform shall not continue any adverse action against the Creator's media or account during this period, unless the Creator's continued usage of the Platform creates or maintains an unsafe condition for users or Platform staff or creates or maintains a state of misinformation.
- Pursuant to any rebuttal statement by the Creator, Platform and Creator shall continue communication until the matter is resolved, either in the favor of the Creator or the Platform, based on the actual and verifiable claims made by both sides. This continued communication is to be without prejudice on either side, and is largely to ensure neither party is misunderstood or misinterpreted.
- Platform may not unilaterally uphold its own ban decision without verifiable cause and the corroboration of an unbiased 3rd party - be it a court, judge, or other authority recognized by both parties.
- Cause shall be deemed verifiable only by a preponderance of the evidence and its interpretation by the general legal definition of 'a reasonable person' within the appropriate local or national jurisdiction for the Platform and/or Creator.
- If the Platform and Creator reach an impasse at this stage, a temporary account suspension may be granted, with any revenue generated held in escrow, and the matter should proceed to a civil court, the level of which would be appropriate pursuant to the amount of revenue that would be lost as a result of the potential ban or suspension.
- Platform may not unilaterally uphold its own ban decision without verifiable cause and the corroboration of an unbiased 3rd party - be it a court, judge, or other authority recognized by both parties.
- Exceptions: Platform shall remain required to inform Creator of all items in section 2 above in all cases without exception; however, in certain cases, exceptions will need to be made to certain elements of the Platform's response, similarly to exceptions in the 1st Amendment to the US Constitution when an individual's speech is not protected.
- Platform shall retain the right to hide, make private, or otherwise suppress the infracting piece of media in the event that the media is verifiably inciting or promoting violence, treason, or major crimes.
- Platform shall retain the right to hide any piece of media in regions where the media content itself is illegal - and must inform Creator of all specifics of its doing so.
This petition acknowledges that Platforms are home to millions of Creators, and as such have enacted several automated systems for enforcing policy. But the Platforms must also acknowledge that without those millions of Creators, they would not be reaping the benefits of billions in revenue. Tell these Platforms that they must be held accountable for their actions against Creators. Tell the Platforms that without human intervention, their policy enforcement is fatally flawed.
Make the Social Media Platforms be fully transparent and accountable to their Content Creators, so that everyone can benefit from this era of information sharing.
