Maintain age of consent at 18 under POCSO in India

The Issue

In 2022, a 16-year-old girl from Uttar Pradesh eloped with her 22-year-old neighbour. Her family filed a POCSO case. During the trial, she testified that she "loved" him and had consented to the relationship. However, evidence revealed a darker narrative: the young girl had been groomed via WhatsApp. Her neighbour had lured her into the relationship with promises of marriage and had made explicit demands, even threatening suicide if she refused. Subsequently, it was discovered that she was already 20 weeks pregnant. After delivery, he disappeared, married another woman, and denied paternity. This once hopeful young girl now resides in a shelter, disowned by her family and deceived by the man she thought she loved.

Lowering the age of consent to 16 under the Protection of Children from Sexual Offences Act (POCSO) is not only reckless but also unconstitutional. Teenagers, like the girl from Uttar Pradesh, are inherently vulnerable and more prone to coercion. A recent 180% surge in prosecutions under POCSO demonstrates its effectiveness as a deterrent, highlighting the importance of maintaining its current stipulations as a crucial protective measure.

Moreover, India is grappling with significant social issues such as human trafficking, rampant poverty, and gender inequality. In such an environment, the age of 18 serves as a vital safeguard against exploitation and abuse. It offers an additional layer of protection to minors, ensuring they are not coerced or manipulated by those who wish to exploit their vulnerability. Lowering the age of consent would only exacerbate these issues and leave our youth more susceptible to predation.

The court must prioritise the rights and safety of minors. Upholding the age of consent at 18 ensures that vulnerable teenagers are shielded from potential exploitation until they are mature enough to make informed decisions about their relationships and sexual health.
