Jaime has asked me to respond to your concerns. The following information is from our General Counsel:
Under RCW 43.06.220, the Governor has certain powers after issuing a proclamation for a state of emergency. Under section (1)(i), he can prohibit activities to help preserve and maintain life, health, property or the public space. However, section (2) substantially constrains this authority. He may only waive or suspend certain statutory obligations, which are listed in the statute and further specified by chapter 181, Laws of 2008. Because the State Fireworks Law, which currently allows for the use of fireworks between June 28th and July 5th, is not part of this list, our legal analysis indicates the Governor likely does not have the authority to waive this law.
