Conduct widespread public consultation on Bill 10 - Childcare Modernization Act - and amend to make provision for parents to freely choose the early learning environments that are best for their families
The Issue
According to the 1948 UN Universal Declaration of Human Rights, Article 26, Section 3, "parents have a prior right to FREELY choose the kind of education that shall be given to their children." Bill 10 unnecessarily interferes with those rights by giving the government far-reaching powers to vastly limit the provision of alternative models of education delivery.
- Bill 10 does not properly distguish between a home day care, an unlicensed day care centre and a provincially registered private school with early learning program
- Bill 10 gives the Minister of Education freedoms to dictate governance structures, program content and fee structures, thereby removing alternative education delivery models
- Bill 10 gives Ministry of Education staff unilateral freedom to assess excessive administrative penalties while at the same time removes all standard appeal processes present in other legislation
- Bill 10 allows the Minister of Education to avoid public consultation on any subsequent regulations by individual determination of urgency
- Bill 10 does not change any of the circumstances which led to the tragic deaths of children in care recently reported
- Bill 10 will result in the loss of 140,000 well-established early learning spaces in the province as well as 60,000 early learning jobs
- Bill 10 did not receive previous public consultation with affected stakeholders while in draft format
Children's safety is primarily a parental role that should be supported by government but not substituted by government. Public consultation with affected stakeholders can result in amendments to legislation that will see parents and government become appropriate partners in keeping kids safe while ensuring parents remain in the driver's seat of their children's education at all ages.
