I lost my youngest Brother to fentanyl poisoning on 9/7/2020 He was only 23. This changed my life forever I’ll never forget this tragic experience and the manner of his death. We celebrated my sons 10th birthday 9/6/2020 everything was normal for us the next day it reached 6pm my brother had not come out from his room which was very unusual so I went to go check on him Never did I expect to walk into his bedroom only to find him cold, unresponsive with foam coming from his mouth. I started CPR and yelled his name over and over But i was too late he was gone. I couldn’t save him. When the coroner arrived she found what appeared to be prescription Percocet in his wallet and she collected them to be tested. 6 months later we finally received An autopsy and toxicology report that’s when we found out my brothers cause of death was fentanyl intoxication they ruled it an accident and since I found him at home and did not call the police so no police report was filed no criminal investigation was ordered and they closed his case. No justice no closure for my family at all. My little brother was poisoned from someone he called his best friend gave him pills they looked prescription Percocet when in reality they were pure Fentanyl and norfentanyl pills he had no Percocet in his system at all. This is not an accident this is a homicide his case should be criminally investigated and someone should be held responsible for his death. Mothers, Fathers, Brothers, Sisters, Aunts, Uncles, Cousins, Friends & Loved ones all over the U.S are being effected by Fentanyl and it’s deadly outcome.

A person commits drug-induced homicide when he or she unlawfully delivers a controlled substance to another, and any person’s death is caused by the injection, inhalation, absorption, or ingestion of any amount of that controlled substance. Drug dealers are selling counterfeit pills pressed to mimic legitimate pharmaceutical medications such as Xanax, Percocet, and Oxycodone. Instead they contain nothing but useless filler and illicit Fentanyl – which is 50 to 100 times stronger than Heroin – This reprehensible and despicable act is being done solely for financial gain, with absolute reckless disregard for human life – Unleashing the deadliest chemical attack in American history.

 


Illegal fentanyl is sold in the following forms: as a powder, dropped on blotter paper like small candies, in eye droppers or nasal sprays, or made into pills that look like real prescription opioids. Illegal fentanyl is being mixed with other drugs, such as cocaine, heroin, methamphetamine, and MDMA. Our children are dying in record numbers. The judicial systems in many counties refuse to criminally investigate & prosecute the lethal poisoning of our loved ones. As the country struggles to contain the worst drug crisis in its history, families of victims are shattered. They suffer in solitude, staggering under the tremendous weight of shock, loss, sorrow, and outrage.

For those states, such as California, which have no felony murder or drug-induced homicide statute that would apply to overdose situations, prosecutors are left to cobble together a criminal liability theory using a second degree murder or manslaughter charge with a negligence or reckless element. California might make use of its involuntary manslaughter statute. In an effort to combat the rising tide of fatalities, many states have implemented Drug Induced Homicide laws to hold drug dealers accountable for the deaths. Unfortunately, California is not one of those states, despite statistically significant increases in drug overdose death rates. Every drug induced homicide should warrant a criminal investigation! No family should ever have to experience the loss of a loved one from fentanyl poisoning. Those who live in the districts of state senators Sydney Kamlager, Steven Bradford, Scott Wiener, and Nancy Skinner need to work on voting them out. These senators support drug dealers and do not think they should be held accountable when distributing deadly drugs that result in death. I don’t know the reason and I’ll never know why my brother decided to purchase and consume these pills but I do know he did not deserve to have his life cut short at 23 he did not deserve to be deceived to death
