The Issue
Dear friends, family , legal system, FAMM , Governor
We, the concerned citizens and supporters of justice, demand immediate attention to the case of Juan Perez, who has been unjustly sentenced to life without parole. We seek your support in rectifying this grave injustice and ensuring that Juan receives a fair trial and an opportunity for rehabilitation.
My brother Juan did not kill anyone. He did not know the person who committed this crime. This individual took it upon himself to walk toward the victim attempted to rob him and then shot him at close range. He then went back to his car before giving the weapon to a female to hide for him. He sat in his car and watched the victim stagger unto alot and die. This female later turned the weapon in to police. Why wasn't she used as a witness.? She's the accomplice in this case and was never charged! JUAN WAS ALREADY GONE FROM THE SCENE WHEN ALL THIS TOOK PLACE AND HAD NO IDEA THAT A MURDER HAD TOOK PLACE.
Juan Perez is a man who has been wrongfully and unjustly convicted and condemned to spend the rest of his life behind bars. The evidence presented during his trial was insufficient, circumstantial at best, and failed to establish his guilt beyond a reasonable doubt. This miscarriage of justice not only affects Juan but also undermines the credibility of our legal system.
Juan was 22 yrs old who was under the infuenced when questioned and charged. He was confused and unsure of what was going on.
My brother Juan was innocent of murder if anything he shouldv'e been convicted for simple assault and robbery for selling fake drugs to make money for his own use. He's been in prison for 34 yrs and that is still too much time.
Juan needed rehabilitation NOT prison.
The following facts highlight the flaws in Juan's case:
1. Juan had a physical altercation with the deceased in question. he left the scene and the victim was still alive according to a witness that was never used to testify on Juan's behalf. There was witness that stated that Juan was not no longer at the scene when the murder took place. He was charged with a weapon and he did not have a weapon. He was asked by the JUDGE did he own a weapon? Juan replied that he has a BB gun but it was not used to commit any crime.
2. Inadequate legal representation: Throughout the trial proceedings, it became evident that Juan did not receive competent legal counsel necessary for mounting a robust defense. His court appointed Public defender sent another defender in his absence who said and I Quote" Im not even supposed to be here bro and I don't want to be here" Juan did not have a fighting chance!
3. Potential bias within law enforcement: There are concerns regarding potential biases within law enforcement involved in this case, which may have influenced their investigation and subsequent arrest. The officer that made the arrest did'nt show up to court, instead another officer who was not present took the stand as if he was there with his own theory. It has come to our attention that some of the arresting officers in this case were accused of serious miscoduct because they elicited witnesses.
4. The accomplice Jose Uderra who committed the murder in this case was sentenced to DEATH and has been released from prison last April of 2022. How is this person who admitted to killing someone is out FREE and my brother Juan is still in prison serving a life without parole sentence? This does not make any sense!
5. Support from credible witnesses: Numerous individuals have come forward as witnesses testifying to Juan's whereabouts during the time frame in question, providing him with an alibi that was disregarded during his trial.
These facts raise serious doubts about both the fairness and accuracy surrounding Juan's conviction. It is imperative that we address these issues promptly before irreparable continues to damage and condemning a person unjustly like they did with Juan.
We urge you to take immediate action by:
1. Conducting a thorough review of all evidence presented during Juan's trial, ensuring that no crucial information was overlooked or disregarded.
2. Appointing an independent investigative team to reexamine the case, including a comprehensive analysis of the evidence and witness testimonies.
3. Providing Juan with competent legal representation to ensure his rights are protected and that he receives a fair chance at justice. Juan went to trial because he had a right to excercise his constitutional right to a fair trial by jury. He believed in his innocence and instead was condemn with a harsh punishment due to lack of defense. He was not given that chance. He was given a Public defender who scribbled on paper and did not object at Juan's trial because he didn't want to be there! UNBELIEVABLE!! but TRUE!.
4. Juan is currently at SCI Medical Facility. He got sick in 2020 with ASH lungs exposed by COVID. He has both lungs damaged and is on oxygen all day and is transported by wheel chair. We must consider alternative sentencing options like TIME SERVED or COMPASSION RELEASE due to his age and illness. Let's take that into account with any potential mitigating factors and allow for the possibility of rehabilitation.
The fundamental principles of fairness, due process, and justice for all individuals within our society are not being necessarily beimg applied to our blacks and hispanic By addressing this miscarriage of justice in Juan Perez's case, we not only rectify an individual wrong but also uphold the integrity of our legal system as a whole.
