Background
In March 2021, I met the father of my son through Facebook Dating, and by April 2021, I was pregnant. Despite never marrying or cohabiting with him, the father and his family have taken drastic measures to limit my parental rights and restrict my son’s ability to travel outside of the United States. They have specifically targeted my heritage, claiming that India is not a safe country and insisting that my son, as an American citizen, should not be allowed to travel there. They have explicitly stated that they would use the law to destroy me, and their actions have been consistent with these threats.
The father hired an attorney who has aggressively pursued every legal avenue to limit my parental rights. Despite these efforts, I have fought tirelessly for my rights and my son’s well-being. I have not been able to work for the last three years as I am the sole caregiver for my son, which has placed a significant financial burden on me.
Legal Struggles:
I have spent $65,000 in legal fees in an attempt to secure justice, but I have encountered significant obstacles within the family court system. It appears that the system, along with certain attorneys and judges, is biased against immigrant parents, particularly those from non-Hague Convention countries such as India. This bias has resulted in a situation where laws designed to protect families are instead being used to oppress and control immigrant parents.
For the past three years, I have repeatedly requested the court to allow me to travel with my son to visit our family in India. Despite my willingness to comply with all legal requirements, including submitting a bond to ensure our return, the court has consistently denied my requests. My son and I are effectively being held as prisoners within this country, with no apparent legal recourse.
Request for Relief
I am once again appealing to the US authorities and MA Court for justice. As the sole physical and legal custodian of my son, I have the right to travel freely with him, especially to visit our family in India. We are not trying to escape; we simply wish to live our lives without the constant fear of legal retribution from those who seek to control us.
I respectfully request that the court reconsider its position on this matter and grant us the freedom to travel. My son deserves to know his heritage, and I deserve the right to raise him in a manner that honors both of our backgrounds.
Seeking Support from India Embassy , US Embassy and Legal Society Bureaucrats to provide me a sigh of relief. As I am mentally tortured by father of my son who threats me to involve my name in legal cases so I can never ever can be with my family and son. I am totally broken with no penny left.
