Justice for Francisco Nunez: Demand Accountabilty from Los Angeles Sheriff's Department
The Issue
Francisco Nunez was not just an arbitrary number in a crime report; he was a beloved son, the best brother, a loving father, an adored uncle, and a friend to many. His kind, loving nature touched the lives of everyone around him, becoming a beacon of hope and support. Most importantly, Francisco was a savior. He saved my daughter's life when she was just a toddler. He didn't do anything to deserve such a brutal end. His life mattered, and his tragic demise left an unbearable void in our family’s lives, a gap that needs to be filled with the satisfaction of justice and accountability from Los Angeles County Sheriff’s Department , who violated his constitutional rights. Executing his life, tortured him and then dumped his lifeless body just one block away from his home.
On March 9th,2024, Francisco was one of 7 individuals in the area of J-7 and Division street in Lancaster,Ca. This area is only one block away from Francisco’s residence. They were approached by Los Angeles Sheriff’s Department-Lancaster deputies.
Per LASD, deputies were dispatched to the apartment complex for a vehicle theft in progress. The vehicle that LASD claimed the call was for, belonged to Francisco’s friend that was with him. Francisco nor his companions were not stealing any vehicle. Six individuals were accounted for,Francisco was the only one missing. Witnesses at the scene,watched as Francisco ran into an opened field and was chased and detained by deputies. Francisco was never booked into a station nor was there any arrest records found within the inmate locator database. Francisco was never seen alive again.
On March 14th, 2024 Francisco’s lifeless body was found by Los Angeles County Sheriff’s Department. Francisco was found in the same alley about 250 feet away, from his first initial contact with law enforcement just five days prior. We were asked to identify our brother by Los Angeles County Medical Examiner’s office the following day, we observed trauma on his face, hands and throughout Francisco’s body instantly, as well as handcuff marks on his wrists.
Francisco's murder at the hands of those who were chosen to protect us should not remain just another overlooked case. Unfortunately, his situation isn't unique. According to the ACLU, in the Los Angeles County, the nation's largest Sheriff's Department is increasingly under scrutiny for excessive force and misconduct, causing needless deaths and injuries (ACLU SoCal, 2019). This injustice cannot continue to be our reality.
Sheriff Robert Luna, stated in an interview with LA CityView 35, Los Angeles County Sheriffs Department “ Has good systems in place, that end up holding their employees and supervisors accountable when things don’t go right.” For who? Because LASD failed Francisco and his murder is a clear indication that LASD policies and systems are continuing to fail our families and communities.
Los Angeles County Sheriff Department cannot shield law enforcement officers from accountability, when they have committed a crime/s.Deputies are taking matters into their own hands in the communities they serve. Robert Luna must hold accountability on his deputies and department for the kidnapping, torture and murder of our beloved Francisco
Francisco's murder represented a grievous violation of various California civil rights laws, including:
- Fourth Amendment Violation: Francisco Nunez was subjected to an unreasonable seizure , use of force, infringing upon his Fourth Amendment rights protecting against unlawful search and seizure.
The brutal beating inflicted upon him by LASD deputies constituted a clear violation of his constitutional rights. - California Penal Code -Homicide: The fatal injuries sustained by Francisco Nunez constituted homicide under California law.
The use of excessive force resulting in his death was an unlawful act, violating provisions of the California Penal Code pertaining to homicide and unlawful killing.
*California Unruh Civil Rights Act and the Tom Bane Civil Rights Act.
- The use of excessive force bv LASD deputies constitutes discrimination and interference with individuals' constitutional rights, warranting legal action and accountability.
- California Peace Officer Bill of Rights (POBR) Violation: The actions of LASD officers involved in Francisco's death also violated provisions of the California Peace Officer Bill of Rights (POBR).
Misconduct and abuse of authority by law enforcement officers are subject to disciplinary measures under POBR, emphasizing transparency and accountability in police practices.
His memory deserves justice, and the countless others who’ve been victims of excessive force by law enforcement, victims who have been murdered by law enforcement and require a significant shift in the ethos of our law enforcement agencies.
