Justice for Berenice Garcia-Hernandez—Investigate ICE Abuse in Oregon

The Issue

Last week, a U.S. citizen named Berenice Garcia-Hernandez was detained by ICE agents in Gresham, Oregon. Not because she committed a crime, but because she dared to take photos of federal agents in public.

What followed was shocking: agents smashed her car window, pulled her from the vehicle, detained her for seven hours, and still haven’t returned her phone or engagement ring. She was never charged with any crime.

Her only “offense” was exercising her constitutional right to record government officials in public—something courts have repeatedly upheld as protected under the First Amendment.

This isn’t just about one person. It’s about the dangerous precedent this sets. If ICE can detain a U.S. citizen for photographing them, what protections remain for the rest of us? What happens when communities of color are targeted simply for documenting potential abuses of power?

We demand:

  • An immediate and independent investigation by the Oregon Department of Justice and Multnomah County District Attorney’s Office into the actions of ICE agents that day.
  • A public release of all footage and documentation from the incident.
  • The immediate return of Ms. Garcia-Hernandez’s personal property.
  • Broader federal oversight into ICE conduct in Oregon to ensure this never happens again.

No government agency should be allowed to intimidate, detain, or harm citizens for holding them accountable in public view. What happened to Berenice is unacceptable, and if it goes unanswered, it will happen again.
