The Issue

In summer of 2015, a mother, Aubriel, was asked by her ex-stepfather if he could take her 3 year old son, Ahimsa, on vacation while she moved. She agreed. She lives in Colorado. Her ex-stepfather lives in California.

He never came home. 

Aubriel contacted the police after several attempts were made to locate and communicate with her son and ex-stepfather to no avail. She proceeded to file kidnapping charges, however, when her ex-stepfather found out, he filed for emergency custody in California, claiming Ahimsa was abused in every way possible. Beaten, starved, molested during diaper changes. He also requested to waive her right to 30-days notice, which was granted. Aubriel had no idea and temporarily lost guardianship.

In Spring of 2016, Aubriel received word shortly before her court date that her ex-stepfather may have attempted to flee the country and take Ahimsa with him to Pakistan. Thankfully, now he is not permitted to leave this country.

She has been fighting diligently to get her son back. She has two other sons, one of which who is special needs who misses his brother dearly, and one who has never met his big brother except through a computer screen. She posted an emotional plea on Ahimsa's 4th birthday, which in 24 hours, has been viewed over 14,000 times.

On July 29, 2016, Aubriel appeared in court against her ex-stepfather. He, his wife, ex-wife, and her sister testified that Aubriel abused him; their friend who is a pediatrician said that Ahimsa weighed 17lbs at 3 years old despite this friend never seeing Ahimsa in her office. There was no record of an appointment and medical records from Colorado show differently. They claimed Aubriel was a drug user who allowed addicts around her son. 3 separate drug tests, including a hair strand test and umbilical cord blood were negative.

On July 31, 2016, it was advised she should agree to a deal that saw her handing over guardianship. She saw this as admitting guilt to abusing Ahimsa even though she never did.

On August 1, 2016, Aubriel bravely refused to admit guilt. She did not accept a deal knowing that handing over guardianship would mean she can not get Ahimsa back. Instead, Aubriel took her chances and let Justice D. Scott Daniels decide.

He awarded guardianship to the kidnappers, A.D. and R.R. Aubriel is allowed 2 weekly 30 min Skype calls with her son.

The judge's reasoning being that he does not see how an entire family would lie and testify against their own family member. He said because Aubriel went on the stand and denied everything, that she was not credible. He stated that there was no physical evidence but that he believed the kidnapper's lies and believed them credible. He mentioned how Ahimsa had been in California for a year with no physical visits from his mother. Forgetting the fact that the mother filed for kidnapping BECAUSE she was not able to see her child. After the temp guardianship was granted and continued for months and months, she also was not allowed to see the child even if she did finally know where he was located.

But, despite it all, because Aubriel bravely did not back down, she has the opportunity to appeal.
