Implement noise fines in San Jose for loud music after 10 p​.​m.

The Issue

San Jose is a vibrant city known for its community spirit and diverse neighborhoods. However, the lack of a specific noise ordinance targeting loud music after 10 p.m. has become a pressing issue for many residents. The absence of fines for those who play loud music between 10 p.m. and 7 a.m. disrupts the peace and quiet that many families and individuals rely on to rest and recuperate.

For many families with young children and elderly residents, peace and quiet are not just luxuries but necessities. Chronic exposure to noise pollution can lead to adverse health effects including sleep disturbances, increased stress levels, and overall reduced well-being. According to the World Health Organization, noise levels above 45–50 decibels at night in residential areas contribute significantly to these health issues.

Furthermore, studies show that a significant number of complaints received by the city's public health and city services department are related to noise disturbances. These complaints reflect the community's plea for a regulatory solution to protect their quality of life.

Currently, neighbors who play music at high volumes late into the night can act without consequence, knowing there are no financial or legal penalties to deter such actions. Implementing a fine specifically for loud music after 10 p.m. would serve as both a deterrent and a tool for empowering residents who value a peaceful neighborhood.

We propose implementing a noise fine policy that clearly defines loud music as sound that can be heard inside a neighbor’s home (even with windows and doors closed) and sound levels that exceed specified decibel limits consistent with recommendations by health organizations.

We urge the city council of San Jose to take immediate action to include and enforce this noise ordinance and hold accountable those who choose to disrupt the community's tranquility. By signing this petition, you stand with us to make San Jose a better place for everyone to live in peace.
