The Issue

The "Guaranteeing Overtime for Truckers Act" (aka GOT Truckers Act) is a proposed bipartisan bill aimed at eliminating the long-standing exemption for truck drivers from overtime pay under the Fair Labor Standards Act (FLSA) of 1938. 

In simpler terms, it seeks to ensure that truck drivers, like most other blue-collar workers, receive time-and-a-half pay for hours worked beyond the standard 40-hour work week.

The Guaranteeing Overtime for Truckers Act would eliminate a federal exemption that unfairly denies truck drivers overtime pay.

Like all hard-working Americans, truckers want to be fairly compensated for all the hours they work. But the Fair Labor Standards Act (FLSA) exempts truckers from its general requirement for overtime pay, meaning that truckers are treated differently than nearly all other professions. This exemption is especially problematic for truckers because they are often paid by the miles they drive, no matter how many hours they work. This means that if a driver experiences delays, whether because of traffic congestion, weather, or as is often the case, waiting to be loaded or unloaded, they are not paid even though they are on the clock. Truckers can easily work 50, 60, or 70 hours in a week, but not be compensated for all this time.

While denying guaranteed pay is first and foremost unfair to truckers, it also contributes to supply chain disruptions. Shippers, receivers, and others place little to no value on a trucker's time when they are waiting to load or unload because drivers are only paid when they are moving. As a result, truckers spend countless unpaid hours at the loading dock. 

Simply put, the FLSA exemption makes it the law that a driver's time is less valued than other professions, pushes safe and experienced drivers out of the industry, and contributes to delays in our nation's supply chain.

The solution to this problem is simple - eliminate the current exemption contained in the FLSA. The Guaranteeing Overtime for Truckers Act is bipartisan, bicameral legislation. By supporting this bill, you can put truckers on equal footing with other professions and ensure they get overtime pay.
