Pass AB 1127: Prohibit Juvenile Strikes from Increasing Adult Sentences
Under California's current three-strikes laws, prior juvenile adjudications constitute prior strikes in later adult criminal cases. This means that if you suffered a serious or violent felony as a teen, later adult convictions result in a sentence that is doubled, or even a life imprisonment sentence because of those juvenile convictions.
The U.S. Supreme Court found that youth cognition and development is not equal to that adults -- thus, children should not be punished as adults. CA has changed laws to reflect this, yet defendants still face life imprisonment for conduct that occurred as juveniles.
AB 1127 would prohibit juvenile adjudications from counting as prior strikes. It would also provide an opportunity for resentencing to those with increased sentences based on the use of juvenile adjudications to increase sentences.
AB 1127 is in line with U.S. Supreme Court logic relating to youth offender culpability, and would correct a significant number of unreasonably harsh sentences. Further, AB 1127 would help decrease overcrowding of CA prisons.
