The Issue
On March 8th 1991 in Edgewater Florida, Norman Larzelere's life got ripped from him due to a masked gunman breaking into his workplace dental office and fatally shooting him. Norman's wife, Virginia Larzelere made a 911 call to dispatch after fighting off the attacker whom shot her husband with a shotgun. Despite extensive details Virginia had described about her husband's attacker such as how he looked, smelled, what car he drove and the fact he got escorted off premises by an individual in a motorcycle, police decided not to believe the story and pin the murder on Virginia herself. Virginia remains in jail to this day because of overlooked evidence such as fingernails never being tested from when she fought off attacker, evidence that has been misrepresented in court such as the concrete weapons were found encased in being tested and found to not be a match (but told in court it was a match) and murder weapons themselves not matching up with the weapons/shavings of the shotgun used. Virginia suffered poor representation of her lawyer as he was found to be doing drugs and upon request for a new attorney to represent her, she was denied access by the court itself despite the fact her then current lawyer was convicted and sent to federal prison for tax fraud and perjury. Because of attorney negligence and misrepresentation, evidence and multiple witnesses that would have helped exonerate Virginia remain unused during the course of her trial and it resulted in Virginia being declared guilty of 1st degree murder placing her on death row in prison. Inconsistent statements made by individuals during her trial were used which included accusations that Virginia and her son were having an affair and they conspired to murder Norman. Virginia's son in his own separate trial was found to be not guilty of murder because the witnesses and evidence that went unused during Virginia's trial was presented at her son's trial. After Virginia's son was found to be innocent, a motion was filed by her new attorney to overthrow her conviction as well as death sentence due to lawyer negligence. In March 2005, due to new circumstantial evidence presented at Virginia's hearing, a judge vacated Virginia's death sentence but continued to uphold Virginia's murder conviction and as a result, she was re-sentenced to life in prison. As of April 20th 2020, Virginia and her attorney filed for post conviction relief. This petition is made on behalf of Virginia Larzelere to help her case either receive exoneration via post conviction relief or be granted a new and fair trial using her current attorney where all evidence previously unused in her previous trial will be submitted in a new trial. Our hope is that by signing this petition, it will pressure Florida officials to take a new look at Virginia Larzerele's case and give her the chance she deserves at a proper trial or grant her freedom via post conviction relief.
